Mother gifted car 6 weeks before death to sibling and there is no money for funeral

This thread makes me feel very sad. Why exactly won't you pay for your mum's funeral? Is it too much to ask???? Poor woman.
I adore my mum and when, God forbid, the worst happens, I will do my best for her funeral, whatever the cost. She told me once that she had enough money put away for it but I told her to spend it on herself and enjoy it.7 Feb 2012: 10st7lbs

That last post makes me sad. We have no idea of the circumstances of bazneol, she may be struggling with money and funerals are very expensive.

dumpy - I had considered that, but when I read through the thread the OP does not give the impression that she can't afford it.

Well the plot thickens. The solicitor doesn't hold a copy of the will and it is missing!

Brothers son is dealing with probate banks, etc. He is just to kind anyone would think there was more to come, they certainly don't want me contacting anyone.
How is he getting probate without the will? AFAIK you can't get a grant of probate unless you are named as an executor in the will.0 -
How very sad - I have just been to my best friends dad's funeral today and for the life in me can never imagine that they argued or fell out over the car, money, who was paying for this, where the will was etc.

You are welcome to judge me. I paid for my fathers funeral 15 years ago because my mother couldn't afford it and my father left no provisions. At the start of mothers illness the doctors informed us it would be very quick and this ment there was time for discussions regarding arrangements. We knew mother had no money and no assets so my brother and myself agreed we would use the car to pay for the funeral. My brother already has his own car.
I shouldn't have to justify my financial circumstances but I will. I have 2 young children and I work full time, I've got no debts but that is because I believe if you can't afford it don't have it. I could get a loan but why should I? My brother on the other hand has always been greedy and purchased what he couldn't afford, he has been bankrupt and he thinks the world owes him a living. He is greedy and alway has been.
I came on the forum to see if anybody could give me legal advice.
With regard to probate I don't understand the system at all I just ment my nephew is dealing with that side of things.0 -
I understand quite well your distrust and anger at your brother. He sounds like a right piece of work dragging your poor mother out of the hospice against their advice. That really doesn't sound like the action of someone devoted and caring at all. Still, I hope the sale of her car provides enough funds for you to give your mother a decent service.
After that, you won't need to have any more contact with him and that will be a very good thing all round.0 -

I remember going over to someone's house the evening that their father died suddenly, and they were discussing who was going to get his car, his new TV and the fridge/freezer! I was gobsmacked.
I remember going to visit OH's aunt in Ireland a few years back. She collected and had on show several dinner place sets, obviously all worth a few pounds. While we were there, 2 of her children came round to visit and, in front of their mum (OH's aunt), started discussing who was going to have what dining set when she popped her clogs.
I was just open mouthed, couldn't believe my ears. She has dementia now. Wouldn't surprise me if I went back and everything had already been taken.
