BHS won't refund

my husband bought me a topfrom bhs for xmas, which didnt fit. we took it back to the store today, who refused to refund it although we had a receipt, and all the labels etc were still on it! we were told that they can not refund anything until the 29th dec, in line with their refund policy. i checked the back of their receipt and online and can find no mention of this. we were able to echange the item, but not get our money back. i didnt want anything else in the store, but had to get something as we live 20 miles from the nearest town and so coming back later in the week wasnt an option! should i have argued with this, or are bhs allowed to do this? they also had all fitting rooms closed, and so anything purchased or exchanged couldnt be tried on, and so may have to go through all this again!

  • does that put any refund request past a (what i think) is a normal 7day limit?

  • no i dont think it was past the 7 day limit, just very annoying! hubby said no signs or anything up. as for being extra busy! quietest day ever in there today! i dont think they can use that as a reason. why is there no mention of it on their website or anything? just a ploy to make you still get something from their store, and not have your money back and go else where i reckon! just didnt think they could do that?
  • Unless their contractual rules differ there is no statutory right to a refund for simply not getting the right size.
    The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

    Ultimately, you have no legal right to return unless it was faulty.

    You're relying on the store's own policy i'm afraid. It likely wouldnt state it on the receipt because that would involve ordering/making different till rolls for xmas period only. A lot of shops extend their return/exchange policy for xmas (till end of january for example) but they are under no legal obligation to do so. If they have a policy which allows you to to get a refund/exchange over and above your statutory rights, they can pretty much have the terms and conditions to suit themselves.

  • yes.i know there is no statutory right to a refund, however bhs's own returns policy clearly states (on the back of the receipt for the item i wanted a refund for) that any unworn/unused garment that was purchased within 1 month can be returned for a refund via the original payment method. the item was bought on the 24th, making it 2 days before returning. there is no mention of not being able to return until a certain date.

  • This is standard as the stores expect a lot of footfall on 26th so do this to limit queues etc. Putting purchasing customer first as it were to guarantee cash in the till. However staff really should use their common sense and treated your case individually (ie, store was quiet and you'd made a special journey)

  • in all fairness to the girl behind till, she did say that the tills were set to not to do refunds! (not too sure on that one though!) she had been told not to do them, and i couldnt be bothered to argue the case. i did find something to exchange it with (socks, for my husband!! i'm sure there's a conspiricy somewhere here!!). i just wondered if they could do it. obviously yes they can. more annoying on my part than anything. just be warned anyone, wanting a refund!

    our local BHS has a dedicated customer service desk where anything for refund/exchanges are dealt their.

    but in my store on boxing day i set up a separate till to handle anyone wanting refund/exchanges as this leaves the main till free to take purchases
