I've not seen any of these signs either. Probably because I avoid retail shopping like the plague. :D

Well oddly enough, with the exception of HMV, I visited all of those stores before Christmas and never saw any such signs. I have asked Mrs Flyboy, her sister-in-law and brother, who are visiting us from the other end of the country and they have have never seen these signs either.

I have probably been a consumer for a good deal longer than you and I have never, ever seen them.

Is my age on my profile? How do you know how long I've been a consumer?!

Oh and if you have been a consumer longer than me, can I suggest a profile name change under the MSE'rs descriptions act cos I couldn't get away with girl so you shouldn't be a boy!

I have seen the signs before and infact have fallen foul of them.

With regards to the legal issue - just because something isn't i nstatute or doesnt ahve case law doesn't mean it is not legally accurate - it would come down to contract law. The contract with the sign up is a different one to one with no sign - that is pretty basic contract law. The main point is, the consumers rememdies are slim even if there has been a breach of contract, so there is pretty much F all they can do about it.

2 points, receipt isnt given until AFTER the contract is concluded so can hardly be used as a basis for the be all and end all of terms and conditions because the consumer has already agreed to the terms of the sale without seeing them. second point is that a receipt doesnt have to be given...........therefore it is perfectly acceptable to have terms agreed verbally and have implied terms also...............

If all that is printed on the receipt is you can return for change of mind within 28 days then as i said before, providing they dont refuse to exchange/refund for a customer who's 28 days would be up on the days they werent accepting returns, they're still fulfilling their contractual obligation.

Or are you going to agree that extended returns policies for xmas period (often extending up to the end of january) arent "legal" because its over and above what is stated on the receipt?

I have never seen a receipt for any store that has a generous returns policy that does not state *Terms & Conditions apply ask in store/check online for full details. I daresay there's at least one dumbass retailer that doesn't have it on their receipts, but its none of the retailers in my area.

    In what sense?

Some times I have seen the signs

On other times I have taken goods back and they have pointed out the signs to me - which I didn't see the first time.

Quite often the signs are not massive so it is not unsurprising if they are missed.

So, instead of actually presenting a sound logical argument to disprove my position, you insult and attack me. There is no debate mileage in such puerile behaviour.

How about trying to act with good manners and treat this thread and those who have contributed to it with, at least, some respect.

There is no mileage in presenting a sound logical argument, you never do, so why should we.

We can justify what we're saying, your basis for discussion is that you are right unless someone else proves you wrong, and when they do you will just ignore it or deflect the point in case - exhibit a is the post above from you.

I was joking, I was having a jovial conversation based on your 'contribution' to this thread.

As for good manners...and respect...I personally thought the comment...

Was incredibly arrogant and rude, you do not know others posting here, despite you're always right way of speaking to others on this forum.

....not much more to say really.
  • I genuinely wasnt being rude. The first part of my post was a wondering, the second was tongue in cheek. Sorry if I offended you, it wasn't my intention.
