Hi - what are my rights regarding this issue: I bought my son a copy of a cd from tesco and his gf also bought the same one, he hasn't listened or played it, phoned tesco they said couldn't take it back as its not their policy to do so!! I would imagine if it had cellophane on it then they would accept it back for refund or exchange, but as most cds from tesco are not cellophaned wrapped, how is it the consumers fault ? they had not got any warnings in the store by the cds to say that they wouldn't do a refund or exchange either - what can I do now!! I only wanted an exchange and would of paid any extra money if it cost more. I think this is bad for consumers and we get a rough deal from this as it seems that Tesco can just keep your money and you have no rights!! Thanks

Nothing you can do. You have no rights at all if it's a duplicate gift, or if you've just changed your mind. eBay?One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

thanks - I just think that it really isn't fair, tesco should cellophane all their cds or do what game does with those stickers!! could understand that if seals were broken or no cellophane then no refund, but no warning signs instores, no cellophane or anything - its quite a bad deal for consumers!!Comp wins 2013:160 finish quantum tabs, 2xtickets private screening of prisoners(Jake n Hugh 2)

It's not really a bad deal. Why should Tesco lose out because of miscommunication between you and your son's gf?One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0

tbh I can't see how this is Tesco's fault - a cd was bought by two people and becuase Tesco won't take one copy back,they are in the wrong.
Strangely enough I doubt very much as well that Tesco either unwrap all the cds delivered to their warehouses so that people can't take any mis-bought cds back.
And as far as I am aware there isn't any legislation that forces retailers to accept returns just becuase the shopper has changed their mind.
Instead of blaming tesco for the lack of warnings - perhaps you should be kicking yourself for the lack of communication with your son's girlfriend?
As someone has already suggested, I think ebay is your only hope of getting any money back2014 Target;

I ordered my son a dvd boxset from Amazon and it was sent out on the 2nd of December. Unfortunately he got 2 of the same so I had a look on my Amazon account and they accept returns until the 31st of January. I'm glad I didn't get it from Tesco! It's a bit unfortunate for you as everyone's not to know what everyone else is going to get for Christmas.0

Your son's girlfriend didn't get her CD from Amazon by any chance? Then she could return that one.0

You bought it in-store.
It isn't faulty.
You have no right to an exchange or refund.British Ex-pat in British Columbia!0 -
not really the point though is it! if a friend of his just turned up and bought him the same thing as someone else, you would expect to be able to change it (like most stores do, whether it be a toy or baked beans) and most stores do exchange gifts as repeats do happen at christmas/birthdays etc - legally there maybe nothing on this, but I think its fair on Tesco (or any other store) to make sure things like cds are cellophaned then customers know where they stand on returns (if not faulty!) and signage on this particular policy should be instore too!!Comp wins 2013:160 finish quantum tabs, 2xtickets private screening of prisoners(Jake n Hugh 2)
