Mis-sold 3DS Skylanders game? Rights to return?

All Gamestation games are open before sale.
The distinction is important, because whilst I entirely agree that Gamestation don't tend to make an issue over packaging with regards to returns, other stores have methods in place to prevent people from returning gutted games after playing them. GAME, for example, place a sticker seal over the side of the box that opens, so if you play the game it has to be removed. I don't know why you think it is funny because the game cost £55. You think it acceptable for a retailer to misrepresent the product that costs that muchh money - well why on earth are you posting on here? Again, from the link above 'If a second player wants to join the game at anytime, add their toy, next to the first toy on the Portal of Power, and they will join you.' The instructions, inside a sealed envelope, tell you that you cannot have more than one figure on the portal.
I've been through the SOGA and yes, it is not as described (they use the term but this means it is class Faulty and my Statutory Right apply) and on their site it states that if a product is faulty I will be entitled to a repair, exchange or refund.0 -

Thanks for the reply Jamie, because this was a starter pack it was sealed. Even if it was not, the only way you could find out that it was not multiplayer is by opening the envelope that is inside the box that has the little stat cards, poster and Quick Start guide inside. Where it says about adding more items to the portal in the instruction booklet it says to refer to the quick start guide.
I asked the sales assistant about the game before I bought it - and I appreciate it will be his word against mine - and specifically asked 'can they play this game together on the 3DS like you can on the Wii' and was told yes, that I was to put the figures on the portal. I even had him hide it from both the children as they were with me and it was their Xmas present.
Their site still states that it is a 2 player game and I posted the info above. It says 'another player can enter the game' and if you scroll up in the link it will show you that it is for the platform '3DS'. So this means it is not as described - SOGA say this means the item is classed as being faulty.
I am just going to take all of the print outs I have, into store tomorrow.0 -

However, the characters themselves can be transferred to other versions of the game (Wii, 360, PS3) and used to battle friends on those versions. Which is perhaps where the confusion has cropped up with the sales assistant. You cannot play the game multiplayer on the 3DS platform, but you can use characters created using that platform to play multiplayer on other platforms.
Having worked for Gamestation, they keep few, if any, non-gutted stock behind the counter. It's usually only huge releases like GTA, COD, Halo, GOW etc that they will have sealed copies of. However, as gutting is the norm at Gamestation, they don't use "this game isn't sealed" as an excuse to deny returns.
OP, may I suggest that before you go in all guns blazing, you approach the till with your 3DS version, the receipt, and the Wii version, and politely ask for an exchange. You'll likely find the answer will be "yes".
If you go in quoting SOGA and laying down a shedload of printouts, you'll probably just unnecessarily pi*s the staff off...0 -

The full info in the link is info for the game in general rather than the specific platform.They probably should have done a seperate one for the 3DS!

How often do they use the excuse, "we can't refund that, it has been opened?"
While I can't comment on this particular game, my own experience of Gamestation is that they are usually quite cool with returning games if you have a genuine reason to return (like you seem to have here). So long as you don't make a habit of it, and then they will think you are up to something. Take a polite approach - you will more likely get the result you want that way.
As has been stated, Gamestation do normally sell mainly unsealed games - unless you specifically asked for a sealed one - so this is not an issue for them.
Game are 50/50 with unsealed, but yes they put a security sticker on.
Asda and Morrisons often sell unsealed games, but Tesco are normally sealed.0 -
Just to update, Been to store this morning and got a full refund as they were sold out of the Wii version. I had used trade ins to buy it and they said they would credit the amount to my card with trade in credits on it - however, we bought a new wii instead as the other died a death on Xmas day.
They did not even know themselves that the 3DS platform was one player only either - they all thought it was 2 player. They have taken the info I printed from their website and told me they would tell Head Office about it so it does not happen again.0 -

Sorry Blue_monkey, I was referring to your closing sentence and your assumption that, although you had every justification to insist that the game was sold "not as described," they would not argue the toss about it. When we see so many times that some retailers are more predisposed to argue about it than others.The greater danger, for most of us, lies not in setting our aim too high and falling short; but in setting our aim too low and achieving our mark0 -
Apology accepted.
There was no arguing - in fact they looked quite embarrassed that not one of them knew that it was not a multi player platform - or that the portal was not big enough for 2 figures. never mind, all done now. They were sold out of the Wii one but we needed a new Wii and they had one for £80 so we used the money towards that, I had some money from Trade Ins on a card and so I had to pay the grand total of £1.
Then we went to Toys R Us for the kids to spend their Xmas money and we found it in there for £10 less. And I had a £5 voucher.
Good result all round really.0 -
