Mis-sold 3DS Skylanders game? Rights to return?

I went to Gamestation to buy Skylanders after seeing it at the Ideal Home Exhibition. My friend and I were playing the Wii version together and you can put 2 character on the same portal.

I went to GS and specificly asked them if the 3DS version was the same, could 2 players put the characters on the portal to play at the same time and was told yes. I also asked if the other person needed a game card and was told no.

Santa has delivered it today and reading through the booklet - which is inside the sealed box and a sealed envelope - it tells me that only one character can use the portal at a time.

So it is actually no good for what I need it for and that is for both kids to play the game together. I have scoured the outside of the box and there is nothing at all on there about it being one player - usually there are symbols on the back of the box that say how many people can play and how many game cards are required but there is nothing, not on the outer or on the back of the game box, it only says it in the instructions.

Anyone know what my rights to return are on something like this please? I just want to swap it for the wii version which can be used with 2 characters. Am feeling a bit miffed, I can get £31 for trading it in (which I'll do if I have to and buy the Wii version) but am a bit miffed as I asked the question for a reason and they have old me something that both kids cannot play - I have to buy a complete new starter pack for the other child which is going to be around £55.

    Each toy is a protector of Skyland, frozen by Chaos and banished to earth as a toy. Place your toy on the Portal of Power to watch them appear in the game ready to do your bidding, well, you are the Portal Master after all. If a second player wants to join the game at anytime, add their toy, next to the first toy on the Portal of Power, and they will join you. If you need to change your character to access their unique abilities simply switch out your current toy and put another on the Portal of Power.

    Right, am I being a numpty or what, the instructions say that 'the Portal of Power can only support one player, location or magic item at a time. Please see instruction booklet for additional figure usage'.

    In the instruction booklet it says 'Although only one Skylander can be placed on the Portal of Power at a time, a minimum of 2 figures are required to play'. There is absolutely nothing about 2 people playing together in the instructions. Does anyone have any idea how this works on the 3DS please as all of the gumf online says 2 people can play at the same time - and obviously, on the 3DS this would have to be on different consoles. I am reluctant to start messing around playing with and saving things on the game cartridge.

    I mistakenly bought Skylanders for the Xbox instead of the Wii version from HMV - I went back to another HMV branch and swapped it with no issues.
    However, it was unopened and still shrink-wrapped.

    I would imagine that is only if the game has not been opened.

  • Well, I seem to have spent all day researching this - and apparently it seems that despite them advertising this on their site (link above) as a multi-player game, it is not. it is a sinlge player game and no other figures can be put onto the portal.

    Unfortunately you do not know this until you have opened the game and opened the envelope holding the instructions. There is nothing on the game box. I have printed off the gumpf on their website that shows they describe it as multi-player.

    So now off to research the SOGA as something not as described!! I cannot possibly see how they can argue that it is not as described - despite it being open.

    All Gamestation games are open before sale.
    They 'gut' the games and put the empty boxes out on the shelves. This generally stops people stealing the games. When a box is brought to the tills, the shop assistant finds the game and manual from the drawers behind the till, and pops them in the box, so packaging won't be an issue :)

  • OP Does it need two 3DS and two copies of the game to be multiplayer?
