nightswimmer wrote:Just curious, but how does this work with the data protection act? Are the HMRC exempt from it?
Section 29.1 of the Data Protection Act reads:
29. - (1) Personal data processed for any of the following purposes-
(a) the prevention or detection of crime,
(b) the apprehension or prosecution of offenders, or
(c) the assessment or collection of any tax or duty or of any imposition of a similar nature,
are exempt from the first data protection principle (except to the extent to which it requires compliance with the conditions in Schedules 2 and 3) and section 7 in any case to the extent to which the application of those provisions to the data would be likely to prejudice any of the matters mentioned in this subsection.
- the first data protection principle basically being "Don't tell anyone"!

Lester Piggott was actually very badly advised (or very stupid, one of the two). He'd had his tax inspection, the Revenue had found a few anomalies and calculated he'd underpaid but not by very much. He was sent a bill for the owed tax plus interest plus fine and all he had to do was pay it and accept the financial slap on the wrists.
He wrote them a cheque from an account in his name he hadn't told them about.

What is reassuring is the naievity of people who think that anonymous proxies actually offer any protection whatsoever. There are hundreds of people sitting in prison at the moment (many on Section) who prove the opposite.
The only rule is "If you don't want people to know what you're doing, don't do it."Can I help?0 -
Just ignore him and hopefully he will go away, he's a prat and just enjoys baiting everyone. would YOU advertise the fact on a public forum if you were making thousands on the side?
if he is telling the truth, he's no better than a benefit cheat who claims whilst working on the side. but no, he's better and more clever than everyone else, we're all just stupid sheep paying our extra taxes, so what if he pays £10k tax or £100k , on his normal job, for that matter, it doesn't make it right. oh, and he thinks we're all jealous of him!

As most people sell stuff on eBay second hand or in fact cheaper than it cost, then they are not making a profit, so have nothing to worry about. Ditto unwanted gifts. Its the 'back of a lorry traders' the IR are after, so worry not.0 -
Most of my ebay is me buying clothes and t-shirts, computer games and other useless crap with my disposable income.
75% of that crap gets sold on because I dont want it or dont like it. Or play it then sell it after im bored. But according to the tax man they need to know about this even if I dont make money. ridiculous.
Best expample is I bought about 6 or 7 pairs of jeans a couple of weeks ago, knowing only 1 or 2 at best will fit ok and I can throw the others back on ebay.
Ive been told by an advisor on the phone that they really dont care if youre making less than £1500.
I was also advised by another person on the phone to keep my business running at a loss, that way I could get my mobile fone and internet bills for free!!!!0 -
I mostly agree with you but I’m not going to ignore him.windswept wrote:Just ignore him and hopefully he will go away, he's a prat and just enjoys baiting everyone. would YOU advertise the fact on a public forum if you were making thousands on the side?

GET A LIFE.
I’m going to track him down, grass him to the Revenue and maybe he will be PUT away.

Perhaps not quite, but you do raise a valid point that "tax" is a two way street. As well as paying tax on your profit, you can also get tax relief on your loss. Can be very handy for offsetting against tax liability elsewhere.0 -
I could easily continue to lose money on buying and selling... declare these losses... and what the tax I pay in my full time job will be lowered?!?
If this is true then maybe I should get me own back. If they harassed me for so long about a hobbie that reaped little profits then maybe I should call my current tradings a business, all be it personal and at a loss.0
