  • Please, everyone don't be put off by the prospect of going to court, The banks want you to feel this way so that you don't go through with it.

    IMO they don't want to go to court and have a judgement against them for the simple reason, If the decision goes against the bank as it no doubt will, this sets a precedent, hope that's how you spell it.

    It would then be their responsibility to deal with all their other customer accounts and refund all the charges without anyone having to claim them, when this happens with one then the rest of the banks would have to follow, costing them millions.

    I know sometimes it's a bit daunting to do this sort of thing when it comes to the legal side but the more people who claim and get their charges back the more help will be out there.

    Also would anyone who has went right through this process please come back and help other by telling how you went about it and answering some of the questions, you were in the same position at some time.

    That was tooooooooo close!

    I got to the court for my 12pm appointment on time, they were running behind, so sat waiting. No-one from the abbey was there. At 12.30 i checked my voice mail and had a message from the abbey, so called them back and they said they did not know the hearing was today! (even though they sent a letter about the date) they asked what i would like them to do, i said settle full amount less interest and i will drop it. So settled for £3,500!! Although they did say it was subject to them clearing that it was ok, so not counting chickens just yet. They did say do not go into the court now just tell them it is settled and go, but i did go in anyway and the judge said that was closest ever, and we would have been there for around 4 hours if not more if the abbey had turned up. She then took the details of the settlement then said if they do not settle the amount said then i can still go bck to court.

    So i hope this is now over, until the next time!! I will let you know whenm the money is in my account!

    Thank you all for your help, and this shows keep the faith they will pay (although i wont believe it until the money is in the bank)

  • I never complain about anything, have just accepted the £4600 overdraft charges the HSBC have debited from my account over 6 Years.

    I have sent my first letter today thanks to this site.

    Lets just wait and see !!!

    Really good that abbey offered to settle ooc - just hope they keep to their word now
