  • Update: Today I contacted my local Trading Standards and explained the situation. They agreed with me that if the computer contains standard off the shelf components it is covered by DRS. They told me to email the company again stating this.

    The company's response "we don't use off the shelf components, we order them in specifically for each order"

    Correct me if I'm wrong but I assumed standard off the shelf components meant components that are available from a store and haven't been modified.

    Is this just another dodge or are they right that off the shelf means the components are kept in stock by them?

    As said, just because they order them in does NOT make them custom components. They are not ordering components that are custom to your requirements - just ordering standard components that meet your required specification.

    The crux of the matter is this - did you type in any custom-specific comments to your order, or was everything selected from available options on their website? If the latter then it is NOT custom. ;)

    Everything on the site is selected from drop down menus. Just off the phone with trading standards again and they've advised to go the small claims court route.

    Should I even bother trying to argue with them the meaning of "standard off the shelf" or just send them the LBA next?

    no, go straight for the small claims process, and do your best to let everyone know what a rubbish company they are so future buyers think twice before placing an order.
    I custom build machines. That being, a machine put together with bits, as opposed to buying an OEM machine or buying a machine which has PSU, mem, cpu, etc attached to motherboard..
    There off the shelf compenents they are using, and what makes it 'Custom' is by you picking other items they sell and 'upgrading' your order.....

    LBA first - you'll need to demonstrate you've done this process if it comes to small claims court proceedings.

    I am not sure what you are trying to say but that does not make the order custom under DSR (as has been discussed a number of times on this thread).

    I wouldn't bother wasting any further time debating with them. They clearly think they are in the right or are bluffing. Lets put the faith they have in their understanding of the law to the test :) Send them a LBA (you'll find templates online).

    Alternatively contact your bank first and ask them to action a chargeback as was suggested earlier. It will be quicker than going through the courts :)
