    Not sure about this as there was a essex.gov.uk email address for her in the email.

    It's potentially against the law to post good reviews of your own company or get your staff to do this

    Emma may very well exist. She may also have given him advice that he has misunderstood or taken in a context to suit his own needs.

    This happens all too often. I've had several of my posts misquoted (even to the point that I never said anything even remotely similar to what they claim i said - and funnily enough they can't quote where I said it because it was never said!) to mean something else, had people misinterpret what i say etc. It does happen. Even more so when you're communicating in text as you have no body language/tone of voice to indicate how something is being said.

    Its all too possible he has simply TOLD her that the goods are customised (with him believing they are) and she hasnt questioned this and has advised him accordingly......that although they do not have the unconditional right to cancel, under some circumstances cancellation may be allowed BUT they are entitled to charge for any losses incurred.

    I would go ahead with reporting him to trading standards....make sure you clarify that the goods in question are made up of "off the shelf" components and I would even drop in that apparently he was advised he can charge a cancellation fee by Emma. You never know, what i said above may be correct (or they could have even been reported to TS previously and this is how he knows her name and number) and Emma may not take kindly to the company using her name to try and rip customers off - never mind deprive them of their statutory rights.

  • It's not the first time on this board we have heard that T&Cs have been "approved" by TS. It's usually cobblers and not been checked by a qualified lawyer. And I am sure unholyangel is right that their name is being taken out of context.

    If any layman like me can see they are 100% in the wrong then pretty sure a lawyer familiar with consumer law would tell them so!
