hi wonder if anyone can help, went to paul simon for furniture, was served by the store manager, bought a corner sofa and a swivel chair also 5 years insurance , we told the manager exactly what we wanted as we have an L shaped living area, so the corner sofa can only go one way,when the furniture arrived the corner sofa was completely the wrong way, the swivel chair has not been covered in the same pattern as the corner sofa as asked for , the insurance started nearly 2 months before i even recieved the furniture.
contacted the store imediatley , the nice manager or so we thought was simpley not interested and told me to contact customer services. do i have any rights ?? i have rejected the order and demaded my money back , but they dont want to know !

But there are several points you need to consider...
Is it stated on your order that the chair would be covered in the same material as the sofa?
The L-shaped sofa... How is it described on the order? I imagine these come in 'left handed' and 'right handed'. If you gave the salesman the dimensions of your room, again in writing, you are entitled to rely on his skill and knowledge to ensure that the thing will fit in your room.
You say you have rejected the goods.
You don't say whether that rejection was made in writing either.
You can see the point I am making...
Verbal agreements are equally enforcible, but it may be difficult to determine exactly who said what, and just what was agreed to.
I hope you have covered yourself and if you haven't rejected the goods in writing, then do so now.
Explain in the letter what is wrong, what you expect to happen (goods collected and refund received) and when you expect it to happen (14 days?).
You also need to explain that you will start legal proceedings to recover your money if the above does not happen.
Not sure about the insurance issue.
Is this taken out to cover any finance deal?
If so, maybe it is reasonable to start at the time of order.
If you are paying via a finance deal or have paid any money on a credit card, then your card company or finance company should be able to help.
Might be an idea to have a read of MSE's Section 75 Refunds article.
There is a bit at the bottom of that article about debit card chargeback schemes too.0 -
thanks rejected the goods in writing and asked for a full refund, within 2 hours of recieving it , it does say on the invoice as displayed , after looking , it does say cover swivel chair as sofa, the insurance was for accidental damage , not for finance , i paid for 5 years insurance but im getting 4 years and 10 months!! also when final payment was made it would appear another invoice appeared this with different code for the swivel chair for some reason !!!
also the initials are incorrect on the insurance policy which im sure in the event of a claim this could be a prob.
i didnt check the invoices i trusted the guy was fully trained being the manager.
the guy has made so many mistakes with paperwork ubelievable!!!0 -
Where you say it says on the invoice 'as displayed'... do you mean you saw the furniture before purchasing?0

yes this is what im saying , the guy has messed up the paper work,if it said not as displayed i would have recieved the correct sofa but it says as displaid, if the insurance said mr a j archer i would have the correct document , instead it say mr j archer, on one invoice it says cover the same pattern as sofa on the other it doent !!! any advice welcome where do i stand with this ?????0

Specifically...
you haven't yet mentioned whether the order was for a left handed of right handed sofa, and which one was delivered.
You were advised to write a letter...Explain in a letter what is wrong, what you expect to happen (goods collected and refund received) and when you expect it to happen (14 days?).

we specifically asked for a corner sofa for a particular way,(not in writing) what was delivered is apparently left hand facing, on the receipt this is written in like a long code jumbled up letters and numbers, what we have asked for must be a right hand facing, which would be some other jumbled up code ,and in small print says as displayed, like i say i didnt check the receipt at the point of sale, this guy seemed to know what he was doing .
we payed some cash and some on debit card i am checking with the bank today to see what they can do thanks for the link wealdroam !0
