On the visa disclaimer thing you do online when travelling, one of the questions is: have you ever been arrest for (and then there's a big old list of offenses, one of which is drugs)

Although he would fail the ESTA due to the arrest, he was never convicted and so this would cause less concern to the US in relation to issueing a visa than a convicted person.

Have you ever been arrested or convicted for ...... a violation related to a controlled substance;
