Hi all,
Today we had a sofa delivered, purchased from DFS. They promised to deliver before Xmas. Has a 10 yr guarantee etc etc.
I got home tonight after work, and tried to move it, so slide it across the carpet, and after about a metre, one of the legs crumpled under the sofa.
The leg was screwed securly into a nut, but the timber holding this nut was about 6" x 3" and about half inch thick, and this was stapled (using long staples..) into the end-grain of other timbers....
So in my book, 'not fit for purpose'.
I rang up today, as we now have no usable sofa, and was told the Customer Services manager would come out next week to "look to repair it". But i broadly know my rights.... i can have a refund/repair/replacement.... but my question is... do i have to accept a repair? My feeling is, i'll have a repair if i get a lump of cash refunded....
What annoyed me though was the woman on the phone, when i said "DFS had promised me a sofa by Xmas", and she replied... "well you've got one"!!!................. no one i can sit on !! :mad:

It's up to them if they repair, refund or replace. You can't choose w hich one you will except. You can ask but ultimately it's down to the retailer which solution they will provide.'The More I know about people the Better I like my Dog'

Wrong, under the SOGA you can outright reject for refund given you have had it ten minutes and not deemed to have "accepted" the product.Thinking critically since 1996....0

When you say "not fit for purpose", DFS may point out that the purpose of the sofa isn't to be dragged around on carpet. Sofas are generally made to remain stationary, and so whereas the leg may have been able to hold plenty of weight from above, dragging it across carpet may have caused friction and pressure in the wrong places, and so DFS could argue the damage is due to misuse.
It doesn't have wheels by the sound of it, and therefore you should have moved it by picking it up and placing it down carefully.
If DFS agree to repair, be grateful. Don't expect a big lump sum, you aren't entitled to one.0 -
^ It's a sofa, not a box of cornflakes, it should stand being moved otherwise you'd never be able to hoover under it.

I think being able to move it from time to time consists reasonable use - not like it's being expected to run the london marathon or anything!0

When I vacuum under my sofa, I either tip it on its side, or ask my husband to help me move it.
Ultimately, a sofa is for sitting on. If it was meant to be dragged about, it'd have wheels.0 -
It would be up to the company to prove that though, not the OP to prove otherwise.
An outward rejection should see the company refunding in full. Take your money to a decent place.Thinking critically since 1996....0 -

No, you don't. You should reject for a refund and go elsewhere. Once they repair once they can do it again and again and again.Thinking critically since 1996....0
