Comet-10% retainer..!!!

Did you know that the electrical retailer Comet reserves the right to retain 10% of the selling price on all their goods if you return the goods in a condition they consider to be unfit to sell? We reurned some goods to the value of £40 in their box with the receipt two days after the initial purchase, we received a £36 refund because we had taken the goods out of the box...!!
Is this fair? Is this Legal? (No signs in the shop stating above).

Well seeing as Comet dont have to take goods back at all, they are within there rights to charge this fee but it must be displayed somewhere in store0

The box and it's contents were returned in immaculate condition. The only difference was that the flex was not wrapped up with a small black tie wrap. My concern is that anyone buying from Comet (Ie £1000 TV) taking it home, finding it doesn't fit the intended space will lose 10% (£100) if they try to return the TV.0

Using your example comet could tell them to sod off.
Just changing your mind or finding it "doesn't fit" is not grounds for a refund (even with a 10% charge).
I dont think many people are aware of this, although most decent shops will exchange.0 -
makes no odds if its mint condition or not,they are well within there rights to charge this,my work if anyone reutnrs anything charges a 15% restocking charge,for the hassle of the extra work invlvoed in processing a return,the paper work and putting it back on display so i would imagine comet are in the same boat0

Yes, I'm afraid you don't have the right to return goods which are not faulty so if they agree to take the goods back, it would be a goodwill gesture on their terms.
If the item was faulty, that would be entirely different - but as it wasn't, then they didn't actually have to take it back at all.0 -

Not that I am fanfaring Comet or anything, but I have to say it does get my goat a bit when people moan at traders for doing absolutely nothing wrong!0
