  • Whatever you do do not reply to any pm which is not from a long time poster, the trolls have been known to try to get people in conversation and admit to things which they record and bring up in any claim, should it exist.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

  • Will do thanks for the advice. I am still concerned though, my family member definetly does not want to go to court, doesnt even have the time to research it, hence me being here! I have returned in writting but am not sure if that will be enough?

    They will be able to keep tabs on the thread more easily on that forum as it's more specialised - whereas threads on here disappear off page one of the forum index view after a day or so as it's such a big, busy forum here.

    You can get more info about defence wording and you can read other threads where posters have won cases. IMHO it's a MUCH, much better forum than CAG as far as parking ticket advice (private fake PCNs or Police/Council real PCNs) is concerned.

    The case will be very unlikely to just be thrown out - so what you have done so far probably won't be 'enough'. Hence you do need ongoing help.

    They do not know who parked the car, they have assumed it was the keeper once your defence as been entered they have two choices drop it or go to court and prove it was you who was driving. If they do take it to court you may need more then the I was not the driver defence, if the judge decides you probably were the driver. Unfortunately unlike a criminal court were there is supposed to be no doubt to a persons guilt, at county court 51% is enough!
    Your family member has nothing to worry about as they do not know them and you have no obligation to tell the company who was driving.
    Not being the driver is a defence as long as you were not the driver. When you ignore these companies the biggest problem they have in issuing a claim is who to claim against.
    Most PPC's quote the Thomas case were a judge found that in all probability Stephen Thomas was the driver. In that case the judge was right because Thomas admitted on a forum he was the driver and the PPC produced the post he made.
    In your case if you genuinely were not driving and the court accepts that then you have nothing to worry about, and your family member is not known to them so they can relax.
    As Coupon Mad said it is probably advisable to post on Pepipoo with this as well.
