  • I have 4 options

    Acknowledgment of Service
    Start AOS
    If you need 28 days (rather than 14) from the date of service to prepare your defence, or wish to contest the court's jurisdiction, complete the Acknowledgment of Service (AOS).

    Start Defence
    If you dispute the whole claim or wish to make a claim (a counterclaim) against the claimant, complete the defence form.

    Start Part Admission
    If you admit part of the amount claimed, complete the Admission and the Defence form.

    View Instructions
    If you admit all of the amount claimed, complete the Admission form.
  • Yes....as It was not me it was a family member but I didnt want to admit anything, so I played it safe and wrote friend as it doesnt really matter?

    It is only a starting point but not being the driver is the first part of your defence, but you will need a fall back argument as well.

    You have your defence, thats all you need, you are under no obligation to name the family member, a sworn affidavit in with the defence and the case will be slung out on its ear at the first hearing.
    No contract = no case.

  • Ok so in the return I should write something along the lines of...

    As the registered keeper of this vehicle I explicitly do not admit to being the driver at the time stated. The charge issued is unjust as it does not reflect any loss of earnings from the "offence" being committed. Furthermore the car park is NOT a pay and display but several bays are reserved for residents, which as shown in the provided photo were empty, proving no inconvenience or obstruction had been caused.

    No you should write, in reference to the following claim a sworn affidavit is included to state that at no time was I driving the vehicle in question of which I am the registered keeper therefore I have no contract with ******** in any way shape or form and do not owe ***** the contractual penalty which is claimed.
    I have no further knowledge of any circumstance surrounding the contract that ***** claim to have been broken. As **** seeks the court to grant its penalty as I was not the person they claim to be responsible for the penalty or persons sought in relation to the contract breech, I can offer no further information.

    Do as Vax has posted don't mention anything else about the actual incident as it has nothing to do with you.
