To DLA or not to DLA.

    'why are you so filled with dread about the possibility of needing to appeal?' - I haven't mentioned anything about a DLA appeal let alone being filled with dread about one and as I'm sure you are aware there is no such thing as a foregone conclusion where benefit decisions are concerned.

    there is no battle completing the forms is there?
    so i am assuming that the battle would be being turned down and having to appeal.

    Except there aren't descriptors for DLA in the way that there are for ESA. It depends entirely on care and mobility needs.

    Then I'm sorry but you have also wrongly assumed, what I was saying referred to the likelihood of being given DLA as I was already in the ESA SG i.e because the DWP already recognised the seriousness of my condition being in the SG then getting DLA would be more 'routine'. The battle was merely a figure of speech relating to the basic assessment, I'm still not sure whether I'll even apply, it's hard to decide as I alluded to earlier.

    Yes but care needs are along the lines of looking after yourself, can you look after yourself?

    'can you look after yourself?' - in a word no, I don't, I find living day to day life very, very difficult, I hope getting that admission provides you with some satisfaction.

  • From the Disability Alliance page, it appears the criteria are pretty straightforward.

    The rules for the care component are contained in Section 72 of the Social Security Contributions and Benefits Act 1992.
    For the disability test for the lowest rate DLA care component you must satisfy one of the following conditions: For the disability test for the middle rate DLA care component you must satisfy one of the following conditions: For the disability test for the highest rate DLA care component you must satisfy either of the following:
    • have one of the day needs and one of the night needs shown in the middle rate conditions.
    • you are terminally ill.
