Whats going on with the 'false positives' I noticed he has a few. I left a negative recently (first one since I joined in 2006) and when I looked back ebay had changed it to a neutral.

I watched that episode on ITV2 last week! I love me some Judge Judy!
But the point made is that eBay rules are not fair, and what would be considered fair trade on eBay is NOT considered fair by any reasonable minded person. And sometimes it takes legal action to get proper justice. People selling photos of high value goods on eBay may not be against their rules, but in normal society, it's considered a scam. And that's what the small claims court is for.
Now, can anyone point me to a Judge Judy dressing up outfit for Mrs H. Not long til Christmas...One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0 -

However, I am quite sure that there is an intention to deceive here purely because the seller has a BIN price that is more in line with the physical item than it is with a photo. I think that if the buyer had put this up purely with a 99p price and no BIN then it would be more difficult to see this as a 100% case of deception- by putting a BIN in that is unrealistic for a photo that's where I htink the intention to deceive comes in.
There will alway sbe people queing up to be scammed, you could honestly write across this in felt tip pen 'this is a scam' and people would still bid and then whinge they were ripped off.
