It's now been approx. 4 weeks since any communication has been received from Athena. Have they decided to give up - this early on, surely not??
I was getting rather excited to receive our nasty debt collectors notices and threatening phone calls. I have primed the husband for the phone calls but nothing.....yet!

Hi, I am new to this forum & have just been reading all the posts on Athena Parking charges.
My husband received a Civil parking charge notice back in October 2011 from Athena for parking in Lidl 11min 38secs over the allowed duration. Unfortunately we didn't realise it would be best to ignore it. We sent a letter of appeal and heard nothing back until January 2012. I then sent them an email explaining our reasons for appeal. They emailed back to say unless we had proof of shopping in Lidl on that day our appeal would be declined. Unfortunately I do not keep receipts for much longer than a week let alone 5months. Then 3 weeks ago I received a letter as per the examples on this forum explaining that if we didn't pay they would issue a county court judgement against us.
As we have made contact & appealed should we offer a smaller fee or is it best to now ignore the letters.

They are lying. They cannot "issue a count court judgement", The law doesn't work that way. To get a CCJ the case would have to go to court (very unlikely) you lose (very, very unlikely) than THEN you fail to pay whatever the judge orders within 28 days. This is such a remote possibility that it's not worth worrying about. Just keep ignoring these clowns and don't write to them again.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

I think that only a County Court can issue a county court judgement.0

And they really are pushing their luck. If they are intimating that they can issue CCJs, I'd report it to your local county court or HM Courts Service.
Are you sure that it doesn't say something like "We will arrange for a CCJ to be issued"? Even that isn't accurate, but at least it doesn't say they're issuing it.
Something like "You may have a CCJ issued against you" would be accurate, albeit "economical with the truth".The acquisition of wealth is no longer the driving force in my life.0 -

After digging out the letter & reading through the letter properly & calmly, It states that "our case will be transferred to a debt collection company to pursue". It then goes on to say "It is possible that any action taken in civil courts with regard to this matter could result in the issuing of a county court judgement against you to recover the monies" further down the letter it explains enforcement action following a county court judgement and explains that failing to contact them may result in paying additional costs of enforcement action.
After reading these threads I am guessing these are all scare tactics. Which were starting to work on us if I hadn't seen this thread.0 -

OK. That's not inaccurate.
It is possible that the world will end on 21 December 2012. That's not inaccurate, either.
