amazon left parcel in recycling bin

    i had a case where i ordered a fax machine from viking direct. this never arrived so called viking direct who told me it was delivered you must of signed for it, i said nothing was delivered, so they told me they would contact the courier and get back to me. they did and the couurier company said as their was no one in the left it in the green (recycle bin) in was in all day. i also told viking that if it was left in the recycle bin then it would have gone with the rest of the bin contents as it was bin day. no problem they said they would cancel the invoice and send me another out FOC as it should not have been left anywhere if their was no one to get a signature let along in a bin.
    After the call i thought i would go check my bin and the bin was empty apart from a box with a fax machine in the bottom. i then debated if i should inform viking that i found it or not, but in the end i thought why should i their couriers mistake. the new fax machine arrived the following day and the driver was very sorry at what he did

    That potentially put you on murky ground. It could be argued you committed a fraudulent act (possibly theft) by not notifying the retailer that you had found the original goods. You should have either refused the 2nd delivery, or returned the 1st. By keeping both you were "intending to permanently deprive the retailer of their property". (Otherwise known as theft).

    do you think i would be that daft. i contacted them once i made sure the second one arrived and was told thier error, it would not be cost effective for them to collect either machine, they will claim off courier so keep both machines.

    Aside the fact the retailer is responsible for the blunder... how one earth does anybody make an internet purchase and not have proof of purchase?

    I did but didn't know which story to believe. First ya say couriers fault, you'll keep it, then say you phoned them the next day. Also not sure why you would wait for the second one the arrive before contacting them! Surely you'd just reject delivery or phone them sooner to stop them dispatching the second one..

    I'm thinking you chose the former option and now backtracking :)

    Was it that you hoped that you'd end up being able to keep both while only paying for one?

    it was the latter as it was about 10pm when i checked the bin and the second one would of been dispatched, i never thought of refusing the second delivery. when i called i had my card ready to make payment for the fax even though viking give 30 days to pay
