Car hit from behind - Driver has no Insurance
Hi All,
My Clean Mazda 3 Sport 56 plate, Got hit yesterday from the rear by a Van driver who was not paying attention. It was a very deep scratch and slight dent to the rear bumper. I asked the driver what he was doing and he said he did not understand how it happened. Anyway i asked for his insurance details but he refused to give them to me. I asked why and he said i may put a false claim on him. I decided to push this further but he refused. I decided i would call the police, they were useless and said just exchange details as no-one is injured. Eventually a crowd of lazy youths come along and crowd me asking why don't i let the man go??? i told them to move on, as it it not there concern. This continued for 15 minutes and eventually i just told the man. It is obvious you don't have insurance, van had no road tax on screen either, just give me £200 and i will be off. Intimidation again by the youth around this man and eventually i took £100 gave a receipt and walked away.
Was i right to walk away?? what would you do when encountered by a driver who obviously has no insurance and cannot be trusted to give real details ??
It ****ed me right off as it is because of this the premiums are through the roof now, What punishment will this man get? I believe nothing ???

Have you tried ask mid for his insurance?
If if has no insurance you could report it. 4th of the month the tax maybe in the post.
My bet is he'd had a drink.0 -
I don't want to comment on the rights and wrongs of this, but if i were you i think i'd enquire as to whether the police logged the incident at the time you phoned, if unsure i'd re-report it in person at the station.
It seems odd the youths should get involved, i assume there could be some 'similarity' shall we say between the youths and the driver, who knows what might have been conjured up after you left.
The police might have been disinterested in your call, and that hardly surpises any of us these days, but should a claim for something unpleasant be lodged by the other driver they'll soon be taking a keen interest then, might be an idea to make sure your story is logged..0 -

You can use askmid to obtain any insurance details available.

Thank you, this is what the police said. Then what i don't understand is that there was no roadtax on the van, his details could be false. Of course he has to provide insurance details, to enable the damage to be repaired.
Or do you mean if there is no injury, the police need not be involved.make the most of it, we are only here for the weekend.

He would not provide details and what he gave was more than likely be false. Let's not forget there was no tax on the screen of the van. I have a crime incident number and was told by police

the driver had no tax ,questionable insurance , he gave you £100 cash to forget it

Under the road traffic act there is no requirement to provide insurance details in a non injury road traffic collision. There is however, a requirement to exchange names and addresses.
If you are the driver you MUST:- Stop and remain at the scene for a reasonable time,
- Give your name and address, vehicle registration number, and details of the owner (if different) to anyone with reasonable grounds for asking for these details.
- If you do not exchange those at the scene you must report the accident at a police station as soon as possible and within 24 hours in any case.
- Produce your certificate of insurance to anyone at the scene having reasonable grounds to see it.
- If you don’t have your certificate with you then you may take it to the police station when you report the incident (within 24 hours). This must be produced within seven days.
If you have any doubts we advise you to report the collision regardless of who was at fault.
Failure to do so can mean you are committing two offences;- failure to stop and failure to report.
The penalties for each offence include a fine and penalty points on your licence. The court can also disqualify you from driving for either or both offences.0 -
Your Right, the crowd of youths were gathering, i was being intimated. This is what it has come too. It is a shame, because it creates a two tier system. Those who are law abiding like me and those who are not. Eventually i hope karma catches up with this Manas harsh as it sounds but
