  • seems rather odd they would of let you have 9 loans one after the other and not asked you to pay back the previous one, in my experience u can be totally on your arxx even at the fault of the dwp say not paying into your bank ontime or a clerical error and they still umm n argh over a possibility of a loan, i would defo ask for a copy of the loan forms u r entitled under the data protection act all seems rather dodgy to me!

    some of them were within a week or two of each other, just seems all wrong, keep thinking someone i lived with at the time could of took out the loans

    right i've got the letter done and a covering letter and will send the off tomorrow recorded delivery, will keep you posted, thanks again for advice
  • write to the DCA telling them you are disputing the debt with the DWP and not to contact you further

    right i've heard nothing till today, iqor have sent me screen print outs of the loan dates and amounts for each loan. There was also another letter from a solicitors in seperate envelope stating that if full payment isn't made to iqor in the next 10 days then they will take the debt on and start adding charges onto the amount and take me to court.
    I cant remember taking most of the loans but looks like i'll have to pay now

    They've already admitted they can't do that so invite them to go ahead so that their own admission can be tested in court. This is what they previously told you:
    The limitations Act 1980 does not deny the Department the right to attempt to recover balances. However, the Department is limited in that we cannot pursue a case through civil proceedings where the debt is over 6 years old and there has been no acknowledgement of it by the customer.

    Contact both DWP and iqor by letter. State the loans are DISPUTED with the originator so no further action can be taken at this time. State the evidence supplied so far does not contain AN ORIGINAL SIGNATURE and as such is not proof that you owe the debts. State that should proof be obtained, the debt would still be statute barred and as such legal action cannot be taken against you.

    State that any further contact without copies of the original signed formes will be treated as harrassment and reported to the relevant outhorities including the OFT.

    thanks, just bit wary of them sending to sols and charges adding on, i know the silly charges they can charge and i dont wanna have to for out for that too

    They do this quite a lot. They would usually and it on to the end of an existing crisis loan, or they'd take a little extra from your benefit per fortnight. I was allowed 2 loans, totalling £82 for various things. Some loan amounts they are like £12.
