    tbh I didn't look that closely, just noticed it wasn't identical, let me check ...

    Yes I'm missing "Mobile Data Network", and instead of saying "Set up internet tethering" it says "Personal Hotspot" with one of those spinning busy symbols beside it.

    Also my sliders are circles not rounded rectangles, they changed in iOS 5, I'm not sure why.

    Correct on both counts. US I think, it's just a image I've used before as it shows the point. However the changes to IOS are really cosmetic to this discussion.

    Roaming Data is off by default. The user has to turn roaming ON and there is still a warning below the slider to turn it on that charges can be excessive.

    True to a certain extent. However, the "Mobile Data" option can also be set to off when roaming as a belt and braces approach, and your screenshot doesn't show this. I was once told by Orange's iPhone support team that one should also turn this option off when roaming, possibly because of a bug in iOS that causes some background data to be used when roaming, even when "Data Roaming" is turned off. I'm not sure how true this is though.
