Daleski, for me it's the principal of the matter as I buy my own phones from elsewhere.
If I'd been told upfront about RPI increases or even if it was in bold on my contract then that's my problem and the OFT would say so too.
However as this price increase term was hidden in an unrelated section (terminations) it would appear to be illegal as it is against the good faith of signing the contract.
Not sure I would say it's illegal however it looks highly likely OFCOM will rule that Orange has to let customers leave without penalty for raising the price of the contract mid term.
I am fairly certain they will back down and if they don't people will vote with their feet.
But don't do anything rash or foolish such as ruining your credit history over this small increase.0 -
oh, and what happens if you want to cancel but haven't actually paid for the handset? Do you need to send it back or is it 100% yours when you take on the upgrade?0

Good point as a lot handsets are subsidised so in theory you don't actually 'own' it until the end of the contract but will be very surprised if Orange would actually ask for them back.0 -

Orange are no longer the decent friendly company they used to be. You may get to talk to the lovely staff when you are buying or upgrading, but get a problem (like my Nokia X6 with it's inherent defect) and you get absolutely nowhere. I advise everyone to get out whenever they can before the ship sinks. They can have my extra £1+ for the next five months, they will never get another penny from me.0

Vodafone did this a couple of months ago, and after a long arduous line of Vodafone customer services, ombudsman and Ofcom employees, we've established that unless they increase prices by more than 10%, you have no right to cancel.
This is in direct contradiction to Ofcom GCs, which state that any material detriment is enough to terminate a contract.
Unfortunately, Ofcom don't investigate individual consumer complaints, so you're at the mercy of the ombudsman - and they state the material detriment should be 10% of your total bill or more.
I got out of mine as VF increased the cost of their 0844 calls from 18p to 35p as part of these increased charges, and I make a lot of 0844 calls, so my bill would have been more than 10% higher. Still took an ombudsman investigation though.
Other people cancelled as VF increased out of bundle data costs from £5 for 500mb to £5 for 250mb which meant heavy data users would be much worse off.
So it's worth checking the other charges to see if they're increasing.0 -
just thought i would get my complaint into orange today, so its nicely logged onto the system.
dont know what will happen , im certainly not clever enough to start spouting laws etc, would have quite happily let my contract run its course for the next 12 months at the same tariff , but if they want me to pay more which is feel is unjust and to give me a get out cluase ( possibly ) then im quite happy to move to another company.
i can live without their product, can they live without customers ???0 -
