Please spread the word far and wide to everybody willing to listen that private parking 'fines' are legally unenforeceable and a nasty little scam. You were obviously upset by the experience, do not let others go through it.Still waiting for Parking Eye to send the court summons! Make my day!0

Hi Robin hood, I am on the wrong coputer to get that email but anything along the lines of PE have written to you and in order to defend yourself as the registered keeper(dont divulge you were driving as per previous posts/theads) you wish a copy of footage from WITHIN the store during the time period you were there, you are making this request under sec 7 DPA 1988. You should offer to make yourself available to assist in identfying yourself and also confirm you will provide a description of yourself if required, also let you know where to send your £10 fee if they require it. Bottom line is they will not want to do this. A seperate thread stated a forum user phoned the store and there head of security stated they couldnt provide it as it would breach the DPA.... er i think not! Give it a try and see where you go, i got the impression that the store customer services dept were used to dealing with complaints re PE!0

I have today received an email from Morrisons stating they could not help me as I was not parked on their land, as such I have submitted my 2hr and 2 min cctv DPA request, however please see a copy of my email i sent/receieved from PE(with a few edits to conceal my ID) -

Further to your letter dated 29/11/2011, I would like you to know that in your letter you state I was shopping in Anniesland, I was not shopping there as i was at work, the vehicle of which i am registered keeper was there.As such you have no claim against myself, please feel free to continue your enquiries into the matter however do not engage me with any further correspondence in relation to this Parking charge notice. I would also like to point out that the vehicle in question was moved out of the car park during the time you state. If you decide to send me further correspondence then please provide me with evidence that the car was parked in the same space for both photographs. If you prove this i will offer to pay you only on the basis that this will come to an end, the amount i am offering to pay is £5, made up of your dvla fee and your financial loss, this i feel is generous in light of the fact thie car park in question is a free one. If you choose to pursue this matter can i suggest you save yourself time and effort and proceed to take me to a small claims court. I will say this again, I was not the driver of the vehicle and i was not there, the driver could of been one of many members of my family however I am under absolutly no obligation to inform you of this.
Lastly, per my previous request, Please provide me with an address to send the fee you deem appropriate for my Subject Access Request under the data protection act for all information you hold on myself and my vehicle, this i imagine will include unedited colour pictures of my vehicle and any correspondance you may have had with outside agencies such as DVLA or Morrisons.

Absolutely priceless! They cancelled the fake PCN to try to get you off their back but it didn't work - they must be kicking themselves!
Please carry on, would love to see the final outcome if you refer this to the ICO.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

There are some serious punishments if they dont give you the data from fines to prison sentences.

What penalties are available to the ICO?
* Fines of up to £500,000 for serious contraventions of the DPA;
* 25 Monetary Penalty Notices (MPNs) are expected to be issued each year by the ICO;
* Prison Sentences for deliberate or negligent customer data leaks by individuals within an organisation may also become available;
* DPA compliance costs are set to rise accordingly, for UK organisations.
Data protection is a serious issue for all organisations. I wonder if Parking Eye fully comprehend the whole new world of pain similar to what they put their victims through, now awaits them if the ICO goes with this one?
If the directors don't go to jail they will have to phoenix the company, and come back as CarParkEye, no they can't just copyrighted that one :-)0
