    Had a phone call from Morrisons Tuesday morning, stating - we own the car park, as you appear a decent family man who was genuinly using our shop as a customer we will have the company cancel the notice, i say, ok thank you very much...... "do you still require your data protection request for cctv?" er...... no thanks as long as this is cancelled...... so the best form of defence is knowing who to attack, When i get up from the nightshift im going to email all 3 parking eye email addresses with a further request for all the data they hold on my and my vehicle, including colour photo's....... someone asked me on another forum, what will you do with the data? my reply.... who cares, they probably wont respond so i will make a complaint to the Information Commisioners office for them to begin legal proceedings and i think they will even be criminal prceedings as it is a technical breach of the DPA 1988... although i will still have to wait 40 days.... I have went from being angry to having a bit of fun with this!
    I admire your spirit but sadly this has been done before and to no great effect. PE along with the larger PPC's became wise to this ruse several years ago. I have not heard of a case where a s.7 application was refused.

    PE will respond asking that if you are genuinely making a data subject access request that you send evidence of who you are (copy of a passport or driving licence); and enclose the standard £10 fee.

    They will then reply some days later saying that as the footage/stills they hold contain the personal data of the driver at the time, you must confirm whether you were driver. If you do so you were you'll receive the details they hold. If not then nothing will be forthcoming.

    Don't be surprised if the appeal via Morrisons is also rejected if you happen to confirm that you were the driver of the vehicle at the time as you will have handed them all the evidence they'd need to pursue you through court. Not that they necessarily will but they may well try to use it as an extra lever.

    This is just one of the reasons why it is recommended that you simply ignore PPC's.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    OOps a daisy, i will try and explain my rational behind this, besides causing a huge problem for the land owners such as supermarkets it may make your notices dissapear rather than ignoring loads of threatening letters, with regards to the parking companies, make the request to them for all the info, including all correspondance with dvla for your details etc. In order to make the request to the DVLA the company have to have a data protection registration number, if they fail to comply with your request for your personal data, inform the information commisioner and hopefully they will have their reigistration removed, thus being unable to request personal data from dvla = no more PCN's for others!!!! unless the company change names, which would cost them tens of thousands!!!

    Morrisons have contacted me to say they will have the notices ripped up, there is no car park cctv, only internal to the shop! The photgraphs/ANPR images have been taken on a handheld camera from the rear of the vehicle and as such contain no persons within, they can confirm my identity all they like, i wont care about that, but it is wasting their time which is hopefully not being used to give others PCN's. Also i want the correspondance they had with the Dvla to establish exactly what was said to see if it actually complies with the DVLA rules on obtaining reg keepers from them! Lastly Morrisons cant reject my application, i posted this on another forum and a person local to me contacted the supermarket directly by phone and was told by the store head of security that he couldnt get it as that would be a breach of data protection!!!!! You couldnt make it up! I have a great knowledge in this field and they cant refuse a Subject access request on the grounds of breaching data protection. Times have moved on, there are more than one way to skin the cat(such as ignoring them), take direct action in a roundabout way!!!!!
  • just recieved 2 letters today from parkingeye, 1 said if i pay within 20 days i will only pay £40.00 but the letter has taken 21 days to get to me.
    2nd letter also recieved today says i now owe them £70.00?

    just sent them an e mail cos i want answers.

    What can these people do to me if i don't pay??

    They will send you some more letters and maybe even get their completely unrelated debt collector of the month to give you a phone call or two (most of the debt collectors will be working on a success fee, so won't spend more than they have to on no-hopers)

    This is a scam that requires you to open a dialouge, very carefully laced bate is laid out.
    PPC's know around 60% pay up and another 10% just can not resist a fight and will waste their time trying to be proven right in a "game"
    However the game has had all its rules made up by them, they can change the rules to suit themselves as they are their rules and they will decide who wins.
    Whilst you play this game, they extract the all important information required for any possible court case, the name of the driver who entered in to the contract.
    You can not argue about a contract you claim not to have read as you were not driving.
    Its a fools game arguing with PPC.

    This is just a private company with authority to fine anyone.

    They have just issued a demand for money. If you pay it you will have been scammed and you will be funding their con against the next person.

    On here, most of us have ignored fake PCNs. All that happens in 99.99% of cases is that they...SEND LETTERS. Then...they send MORE LETTERS.

    Pictures of those letters can be viewed in the top thread 'PPC letters, what to expect'. We have all been there, done that, ignored a PPC.

    What they cannot do is they cannot send the boys round, cannot just 'issue a CCJ', cannot put a black mark against your credit rating any more than I could. There would be the small matter of taking you to Small Claims Court and then, you actually losing (almost unheard of). It will not happen.

    Please stop giving this company authority it does not possess. Stop emailing them, stop believing them. Enjoy Christmas safe in the knowledge that you have avoided a scam here.

    How can you ever be possibly" right", they make all the rules, they decide who wins.
    All you will do is pee them off and persuade them to try court, they may loose, they care not, you will loose a days pay fighting this game .
    There is only one proven way to beat this scam that has ever worked.
    Safety in numbers, you join the hordes of those who completely and utterly ignore everything.

  • Just to let you all know.... i received a lovely email from auto response appeals saying as a gesture of good will they would cancel my ticket, either i scared them shitless saying i had spoken to trading standards or they just decided to be nice.... any way i also spoke to my local MP and there going to make the minister aware of the problems they cause. i feel very sorry for the old people who pay the charges without looking in to it. so i have to say im very thankful of all your help. :)
