Buyer in Germany not received item, dispute

Hello

Ive been on ebay for many years however this is the first time i've had a buyer not receive item.

I had a buyer who lived in Germany bid on my item even though item was on ebay.co.uk and said in listing UK only bidders.
When I found out winning bidder lived in germany I said I would post to Germany even though listing was ment to be for UK postage only however strongly advise her to take insurance out on item due to high value of item ( £53.00) and buyer said no.
I informed her that as she did not wish to pay for insurance on item if it went missing I would not be able to refund her as it was her choice not to send item insured.
Item was posted 24/ 10/ 11 and buyer has only contacted me today 23/ 11/11 to inform me she has not received item.
I still have proof of postage for item.

She has put in dispute she has tryed to contact me with no responce from me however this is not true buyer has not tryed to contact me.

My questions are, where do I stand? say I just say the above in my responce?
and finally, buyer has opened dispute on ebay.de and its all in german I cant understand a word or able to find anywhere on site to get it to english what should I do?

    You must refund in full. Or face Paypal doing it for you and leaving you without your paypal fees and a black mark on your eBay account.
  • Why must I refund if its not my fault? I posted item? I dont understand why I need to refund?

  • You need to refund as your buyer doesn't have it. Can you prove they have it? If you can then you are ok. If not, then as they have opened a dispute, you need to refund in FULL.

    Postal insurance is for your benefit not the buyer, as it's your responsibility to get the item to your buyer.
    It's not the buyers fault that the item is lost, you'll need to refund in full including the original p&p paid & put a claim in with RM.

    She doesn't have the item she paid for, so why should she be out of pocket?
  • If you sent it standard airmail then you will get back up to £46 if you have your certificate of posting. Refund, apologise and claim from Royal Mail.

    Why do you hate EBay? They gave you a buyer, they didn't lose your parcel.

    It's been this way for a while, particularly with foreign buyers using ebay.co.uk.

    As a seasoned ebay seller you should be aware of what could go wrong, and should have refused to post the item without insurance.

    What is so particular about foreign buyers? Nothing. It's the same in the UK as out. Provide tracking showing delivery or not. Easy.

    As for insurance, the seller has full responsibility to get the item, whatever the value, to the buyer. End of.
  • It may not be the sellers fault the item got lost but it certainly isnt mine either. Shes obviously alot more cluded up on getting refunds of seller than what I am tbh waiting 4 weeks before contacting me I wouldnt be surprised if she has got item and wants item & a refund.

    How much will royal mail give me for item posted standard?

    So for future interest and this happened again, sold on UK website I only want to post to UK and someone from outside Uk bid and paid for item how to I cancel it? would they be able to leave me negative feedback because I refused to tell to them?
