Continued help required with parking fine

Dear all

A while ago I posted this thread:

https://forums.moneysavingexpert.com/discussion/3472061

Basically my wife parked in a Manchester shopping centre and assumed the parking was free - a quick trip to the shops later and she'd been ticketed by a private company (Excel).

After a bit of umming and aahing I paid off the INVOICE - £60 - but was paid late.

Subsequently we received letters from the company invoicing us for a further £40.

Now I thought it was a bit ridiculous and £60 is a adequate payment for a mistake made on our park - which lost the car park owner £1 is parking payment (how much the stay would have cost).

Since then we have had repeated letters from the company which I ignored based on the advice of this forum (thanks!).

Last week I received a letter from Roxburghe debt collectors asking for £82.

They say 'we would suggest that you refer to the Civil Procedure Rules part 31 - parts 31.16, 31.17.

I have ignored and this morning got a letter from Graham White Solicitors with a 'Notice of Intended Litigation' before proceedings are issued in the County Court.

They write any judgement registered against you oculd seriously affect your chances of obtaining credit in the future and in the event of a Judgement Order not being adhered to, we may seek a warrant of execution. This would allow a Bailiff to attend at your address and remove goods.

I would be grateful for advice on what to do next.

My particular predicament is that I paid £60 originally so did I some way accept that the INVOICE was fair.

Thanks v much

You should not have paid a penny.
Science adjusts its views based on what's observed.
Faith is the denial of observation, so that belief can be preserved.

Carry on ignoring. If they do issue court papers then post over at pepipoo. They won't chance it though.

all paid for parking has plenty of signs to indicate this, if they go to court, they will win.

I accept there were signs indicating it was a paid car park. It was just assumed parking was free - like a supermarket.

You really shouldn't post when you have no idea what you are talking about. It makes you look foolish.
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Please don't listen to Dave101t who pops over here every so often with a load of twaddle. A PPC would 99.9% certainly not win if they tried a Small Claim - it's very rare for them to try and even rarer that they actually convince a judge.

What surprises me is that you posted that original thread and then evidently didn't bother with the advice to read the sticky thread at the top with the pics of the Roxburghe/Graham White letter chains? You may have to look under other PPC letter-chain pictures in that first post but your letters are on there for what on earth are you worried about?
