Nursey nightmare advice please

    How much does the nursery say you owe and how much do you reckon you owe?

    I offered to pay 1000 one off payment as they'd not responded to my originally instalment suggestions then they demanding the lump sum and higher instalments but they hadn't actually looked at my account so the figures they were saying were wrong as they weren't accounting for enough days in my monthly payments. I've always said I could do either/or not both lump sum and additional payments coz I'd have to borrow the cash to make a lump sum so couldn't pay them both back. I wish I did just owe 500 quid at their last count they were saying about 3600 which probably isn't too far off, I need to check everything be sure tho. I know I owe the money I've got no problem with that it just how its got to be paid I've got an issue with.

    Sorry, I misread the terms offered by the nursery.

    They want a lump sum of £500 instead of a lump sum of £1000 and if you don't pay then they'll put the matter in the hands of a debt collection agency. They say you owe £3600 - you haven't come up with your own figures yet (tut, tut!) - and will take the rest of the debt repayments in instalments.

    You are now saying that you can't afford to pay a lump sum AND the weekly instalments. Is that right?

    I can't really see them reducing the lump sum payment any further - they've already halved it - and it would only mean higher weekly repayments for you.

    You could do without being shackled to this debt for years. Is there any way you can clear the debt in one lump sum, once and for all?

    Well for £3600 then I'm guessing they will sue you!

    I know it's tough but you are going to have to find the money pay them back and I would say it would be reasonable on both sides for the debt to be cleared over 12 months.

    Yes they made a mistake but I really struggle to see how someone cannot notice that they are not down over £300 a month in thier bank account.

  • Yea they'll take the reduced 500 and the weekly amount I've always said I could do lump sum and regular payments but this deal only stands if I take my child back (even tho she kicked him out) if I don't agree, her bank will demand immediate payment in full. I don't want my baby going back there I had to make other arrangements when she booted him out, which he is just getting used to, so I don't really want to unsettle him again by changing everything again because she is making demands and I actually prefer his new place.

    Pay her the £500 and give her the regular weekly payments.

    Her bank can't demand anything from you as they are not owed the debt, she is.

    She can sell the debt to debt collectors or she can sue you but her bank can't do anything to you.

    Oh and don't send your child back there if you don't want to as your child is not part of any deal

  • Cheers I think partly it's because I'm just so annoyed by her she can't just willy nilly going treating people like that I know I've been really stupid in a few ways not noticing the money not being taken, then not just making payments when I realised there was a prob, I genuninally have been tryin to sort it out and have been asking and asking for invoices. But it's her attitude, threats and the complete disregard for the care of my child that's really got to me.
  • Whatever you decide regarding payment, the nursery cannot demand that you return your child to the nursery. However, they might decide that they do not want to wait for the money if your child attends a different nursery, and start proceedings to recover the monies owed.

    Before anything, you should determine how much you owe. If this figure differs from the nursery's figure, you need to ask how the amount was calculated. Only once you know how much you owe can you decide how to proceed.

    The nursery is going to lose out. By being difficult they have lost your future custom. They must also be aware that your priority now will be to make sure the new nursery is being paid in full and on time, so the debt to them becomes a very low priority. With no further contract with you they have no weapon to use to endure the debt is paid.

    If they sell to a debt collection agency, they will only get back a very low amount, probably less than half. If they retain the debt but use a debt collection agency they will lose at least 20% of the amount you pay. If they take you to court you may get a CCJ, but they could end up getting £5 a month.

  • Yea I will sort out what I owe I'm dreading it coz I know its gona be a mammoth task. Cheers silvercar I wasn't sure how debt collection agencies work but assumed that it'd cost the nursery a fair few quid to use but do they increase the debt by adding all kinds of interest etc
