It's quite obvious from reading those transcripts that most of our Honourable Members just don't get it, they are still talking as if the BPA are a respectable organisation with a rigorously enforced code of practice.

Some of them, however, seem to recognise that the keeper liability provisions are a complete mish-mash and that the independent appeals process will be unworkable. Let's hope they prevail upon those in the "other place" to realise that.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

The Freedoms Bill was discussed at Committee again on 29th November. I found the discussion and some deluded 'Baroness' actually tried to get an amendment through to allow clamping!!! This is she:

To read everything that was discussed, all the speeches about it, go down to the bottom of this page as all the rest is about DNA database issues:

    Then it continues here:

OMG - but it seems her 'amendment' was withdrawn.

Further to the above, the next Committee discussion of various clauses is tomorrow morning:

Not sure whether they are clauses regarding PPCs though, they may have already moved on to other aspects of the Bill.

I'm told they will be looking at PPC's and recent noteworthy county court cases *very* closely tomorrow.

Really hope so - all it would take would be some basic scrutiny of the PPC model for the rose-coloured specs to be off and the scam revealed to some more clued-up members who will have swallowed the BPA spiel so far. But why do I still feel we will be disappointed...

I agree simply because there is some indication that the argument in favour of having the RK responsibility clause has been the lack of success at court in pursuing drivers thusfar. Examining those cases will undoubtedly depend on the evidence that has been supplied to their Lordships. One could make an educated guess as to where that might come from and it would be fair to assume that the source is hardly neutral.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Perhaps their Lordships should be sat down and shown the watchdog video, to ground them in what the law is, how these clowns abuse it, and how RK responsibility in a contact law case is hardly a solution, notwithstanding the baying hounds of the BPA, slavering in anticipation of a measure that does not address the fundamental issues.

Trouble is Rob, I don't think they actually care. As long as they continue to see their slice of the cake from big business they're more than happy to go along with a lot of it.

I remember on TV a couple of years ago they showed secret footage of one of the peers admitting the favours he'd done for money etc. Scum, absolute s !!! some of these people are. As for their duckhouses... it's absolutely sick.

Unfortunately Tricky, you are right, and they are feeding in the adjacent trough to MP's
