I exchanged my sale item and now had to pay ful price

I recently bought my daughter some clothes in the mothercare buy one get the second half price sale.

My daughter is quite big for her age and getting the right size is always tricky.

I took the items back asking to echange them for bigger sizes and they said because the sale had ended i would have to pay the difference on the items i got for half price is this allowed ?

  • As you have no statutory rights to return items for being the wrong size (unless you are alleging they are faulty in being too small) then it is purely down to the displayed returns policy, if there is one, or the management's discretion if there isnt a published policy.

    Even if you did claim it was a matter of them being faulty/ poorly designed they would still be entitled to decide the mechanism of resolution (ie replacement with a bigger size or refund)

    Seems like a load of bull to me. If you're exchanging like-for-like there shouldn't be an issue. Their website says
    We are happy to refund or exchange any product*† returned within 28 days of purchase, as long as it is returned in its original state, unused and in original packaging. Proof of purchase is required.

    †Exclusions - toiletries, software, DVDs, food (including formula milk), Tens machines, Gift Vouchers, Gift Cards and opened mattresses. If any items are returned that were part of a multi buy promotion all items must be returned.

    *This does not affect your rights if the product is faulty or misdescribed.

    Unless you missed out some info in your original post, you also didnt buy online.

    There may be a different policy in effect for stores.

    Yes, and I'm sure they, as many other retailers, have other T&Cs that cover sale items, particular the one about them being non-returnable unless faulty.

    I'd definately class the same item, different size like for like, only problem is the price has now changed and therefore it's not. So a simple refund/repurchase would be necessary to get the different size
