Now theres an unwelcoming forum towards parking insiders if ever I've found one. I signed up and gave loads of advice there a few years back and got nothing but greif for it. The mods were ok with me being there but the drivers.. :mad:trisontana wrote: »Why would be "screwed" ? PPC tickets will still just be civil law cases. Under that law (be it contract or trespass) the landowner can only claim for the actual loss that has occurred. What the PPC can't claim for is a much larger sum of money that bears no relation to that loss.
All that talk of "independent appeals" and RK responsibility is irrelevant. Just let the PPC take a few cases to court and see how they get on. I can guarantee that the majority of these cases will be thrown out because they would be considered as unfair penalties.
Just like the banks lost in their unfair penalty situation huh?
Seriously, parking is big business in the UK just like banking. You don't really think the government are going to let this go do you?
How also do you define the loss when a parking company has to issue a PCN? - Time to issue it, computer software (which can be expensive when its custom developed), staff and admin costs etc etc. In reality once the new Bill becomes law, you won't be able to prove otherwise.
I agree its a bit of a !!!! what the BPA are doing but they're only doing it because they're so vulnerable and if the government wanted they could put the cockroaches out of business overnight.0 -
It's not the PPC who can claim for the loss. Only the landowner can do that. You are taking this whole business too seriously and trying to equate the private parking industry with that run by councils. They are not the same thing. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

If the PPC have responsibility for the land.
Second you seem to think I'm defending the PPCs. On the contrary I think they're scum but I'm afraid they've stitched up the population with this move and now we must try to help people avoid them.0 -
Things may have changed. There are lawyers, traffic cops, tow truck drivers and even a council traffic person or two.TrickyWicky wrote: »Now theres an unwelcoming forum towards parking insiders if ever I've found one. The person above I am not so sure!
I just thought we were starting to get on so well too
I have had loads of parking tickets, but I just pay because I can't deal with the bother and of course it may not look so good.
And you tried to suggest I know nothing about parking? :rotfl:
If you're going to take the !!!! with parking at least do it properly and get away with it like I do. I've given the council and the PPCs loads of opportunities to whack a ticket on the car if they were determined enough but I use my knowledge and play them at their own game. I've still not had the first one yet

Just like when I was there. I did have a couple of PMs though asking me to setup a blog.. wish I'd done it now to be honest.0 -
There was a film on Film4 tonight about some people having to travel through an alien infected area.
I know how they feel given the rubbish that is being spouted tonight by our new visitors.
Methinks someone in the private parking world of scamdom is a little rattled.0 -
"The new rules will change that as they clearly state that it will be considered trespass. Trespass is a tort. Have you actually read it yourself yet?"
No it does not say that and yes I have read it.0 -
TrickyWicky wrote: »It won't be a contractual issue any longer. It won't be a criminal or civil issue either so it will probably become a tort.
The bill doesn't actually even mention anything about any independent adjudication either. If you want to read it then search for "Protection of Freedoms Bill" and scroll down to Schedule 4: Recovery of unpaid parking charges
Sorry I can't post links.
I'm still waiting for you to explain how a tort of trespass is not a civil issue ??0 -
But county courts won't be involved in minor parking issues. There will be a panel setup by the BPA (who are naturally in on extoring profit from motorists). It won't be a fair system.
Utter pish, the damages/losses sort either by virtue of breach of contract or tort of trespass are recoverable how exactly ?
To put it bluntly what exactly are the non-statutory , no powers , BPA panel going to do if the keeper does not pay ???
The only recourse is for the PPC to claim at County Court as they have to now !0
