            Sorry but I wholly disagree where the land is provided as a car park it is by virtue of contract.
Currently yes. The new rules will change that as they clearly state that it will be considered trespass. Trespass is a tort. Have you actually read it yourself yet?As such the PPC can only issue proceedings on the basis of breach of contract or if the parking is wholly outwith the contract it could possibly be trespass.
(As an aside is the tort of trespass not a civil issue ? If not what is it ?)
Before you start commenting and disagreeing, perhaps you should actually be sure that you know what is really going on before then needing to ask questions (in brackets). There is a difference between a civil offence and a civil issue. I suggest you hit dictionary.com and look up the word tort. A civil offense is a breach of the law.Either way only a driver could have entered into any contract and only the driver could commit a trespass ...which makes "keeper liability" in Schedule 4 a whole heap of nothing ! :-)
Thats the current situation yes. The new rules will change that completely and it will become a tort hence there will be legal implications for the registered keeper to supply the drivers details or pay the fine.
I've seen your type before argue that cars can't get a ticket for yellow line parking if the wheels aren't actually on the yellow lines. The Road Traffic Act and the more recent Traffic Management Act define the area covered by yellow lines as the pavement upto the border of private property and out to the middle of the road. Just because you are 'morally' right doesn't mean that they've not legislated that morality out of the window.As for adjudication the bill doesn't include it but parliament are clear that Schedule 4 will not take effect until such time as an independent adjudication panel exists ...however that's pretty irrelevant too as we already have the County Court as an adjudication method !
But county courts won't be involved in minor parking issues. There will be a panel setup by the BPA (who are naturally in on extoring profit from motorists). It won't be a fair system.0 -

Well I am sorry, I now know law!. I think you are the only person on here that knows what's what.
I don't work in the private sector so that rubbish about me being scum is not true as I work for LA.
Anyway going on, the BPA at the last meeting are asking the Operators to fund the changes, however I will add that nearly all Operators are approaching the Lords to see what can be done to change.

Also to conclude I am NOT on the side of the clamper!. I would have been happy to tell you everything discussed in the room yesterday, including what the DFT, DVLA and the Home Office had to say, I also had a point from The Data Commissioner, but people on here just do not want to know.

            Why would be "screwed" ? PPC tickets will still just be civil law cases. Under that law (be it contract or trespass) the landowner can only claim for the actual loss that has occurred. What the PPC can't claim for is a much larger sum of money that bears no relation to that loss.
All that talk of "independent appeals" and RK responsibility is irrelevant. Just let the PPC take a few cases to court and see how they get on. I can guarantee that the majority of these cases will be thrown out because they would be considered as unfair penalties.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Mate I wouldn't worry about it. People here will always be aggressive towards those of us in the parking industry. I'm used to it - I've been out on street and faced it. I've had people an inch away from my face threatening physical violence and other nasty things. Water and a ducks back.
Seriously, chill. No need to leave the forum or stop posting etc. All inside knowledge on parking forums is a good thing

            I admire ptp, you do seem to know everything about the subject. The person above I am not so sure!. Glad that I posted though and got to know who is who. I have had loads of parking tickets, but I just pay because I can't deal with the bother and of course it may not look so good.
