  • Ok well I am off to sleep now, regardless disabled uk is not disability uk, regarding the pc, you can say "disabled", because what else do we refer to the blue badge as a "disabled badge" and a "disabled badge holder". I will however check who that charity were and confirm, of course I may be wrong with the name. I also thanked all of the responses tonight!.
  • I quit the UK nearly 10 years ago for NZ and I see its got much worse.

    I also heard the UK has developed an obsession with car insurance and British TV is now dominated by it.

    Well I guess you could say that, but I don't know what it is like in NZ.

    You learn to live with it I guess, when the Country needs money they make a new bill lol.

    NZ sounds nice by the way, if only I could...:(

    No, no new powers.
    The keeper becomes liable to be claimed against in the County Court (provided the driver is not identified as another)....whether they are actually liable to pay is still up to that court to decide.

    Honestly have no clue what you are on about or why you started this thread. But if there is an article at any point maybe that will make more sense...or maybe it won't if you can't say who you are.

    Dunno what you mean by 'so many people would want to appeal'. I wouldn't; lots of people wouldn't be so stupid as to take a fake PCN from a private company seriously.

    Why so secretive if it involves the DfT, Home office, and DVLA it should be made public anyway! Oh and Disabled UK who ever they are?

  • So, AssJ, this "independent" adjudication, who is paying for it? Last time in the Lords it was BPA or industry were to pay. Whereas the BPA said it won't start until the government would pay and keeper liability would also depend on the adjudication being in place. Has the impasse been broken? To make it as "fair" as the council one, will you be publishing all terms and conditions online? Will all the terms be common throughout England? Will all signs be in the same fonts/typeface size as councils? If so link please to where this is published, if not why not.

    As it stands, the keeper would be 'liable' for a charge made under the law of contract. The problem is that the law of contract can't make anyone liable for a contract they were never offered. So it's Catch 22.

    In reality, all that will happen if the PPC's will throw in some threats about the Act in their threatening junkmail.

    It won't be a contractual issue any longer. It won't be a criminal or civil issue either so it will probably become a tort.

    The bill doesn't actually even mention anything about any independent adjudication either. If you want to read it then search for "Protection of Freedoms Bill" and scroll down to Schedule 4: Recovery of unpaid parking charges
