three contract

Just wondered if anyone could give me thoughts / advice?

I took out a contract Thursday for a birthday present for my son, I phoned three (who I use and hubby) and they offered me Blackberry 9360 for £17 p/m which I took. The phone arrived this morning and my son was thrilled with it.

I received a call at 7pm from three telling me that they had given the wrong phone and I had to increase my plan to £25 p/m or send phone back (i don't really want to take the present away and replace it with the model down)

As the contract was agreed and verified by a supervisor can they do this? Surely it must be breaching the contract?

Please help!

  • I believe that 14 day cool-off period you have also applies to 3 as well.
  • I dont want to spoil the party, but how old is your Son?
    if hes not old enough to have a contract in his own name, then theres a risk of a very large bill being run up, and you being responsable.If you read therough this forum there are plenty of horror stories about such things happening, bue to reverse text charges, data roaming and os on.

    you may be better off with a pay as you go handset, or a sim free phone.

    Your belief is incorrect.
    It's not that I am saying that the buyer can always enforce the contract.
  • Richard_t : I would have put a block on the account and followed it up by email so phone bills cannot be built up, also I would have created an online account so I could track usage! Have already thought about how to stop this as it happened to my cousin!

    I mean that a cooling off period is in place to protect consumers if they change their mind, not retailers.
    However, there is a place for 'mistake' in the contract law. The retailer can ask a court to declare the contract void due to a unilateral mistake.

    Do you know how much free stuff you get with 3 when you top up?
    I think that's got to be better value than any contract.
    Have you considered buying the phone outright and going payg?
  • Jimmythewig: I was just looking at paygo and for £15 you can get all you can eat data, 300 mins and 3000 texts but the phone would cost £210 approx which over 24 months totals £570 whereas contract would cost £408. Unless there is a cheaper top up I don't know about?

    Thank you all for help, advice it gives me another avenue to explore!

    What kind of 'block' do you mean? AFIK, '3' don't do capped tariffs and I don't think that they will ever agree to put temporary blocks and remove them on your requests.

    Once again you are incorrect, please don't comment if you don't know
    the workings of the network you are talking about ;)

    They can and do put temporary blocks when you request them, and will
    remove them when requested, all at no charge..
