"perfect comdition"

hi,
just wondering peoples thoughts on this
i won a item a few nights ago which was suppost to be in "perfect condition" as stated in the listing
i spoke to the seller on the phone and asked several times what condtion it was in, they replied mint as the auction says
they asked about a mutual cancellation to avoid fees which i was ok with as it made it a bit cheaper for me, this raised a few alarms in my head but i could see why they would want to do it
so i drove down to collect it, when i inspected it there were significant scratches on it on one part of it, i expect wear and tear but not scratches (deep down to the metal)
after looking it over i deceided not to buy it
they had another buyer lined up so they agreed to it
i like my things to be in good condition and i knew if i bought it i would always be looking for one in better condition
so they have asked to a mutual cancelation which i will agree to
but what bugs me is the two hours driving to see it, that was a total waste of my time
what would you do? mutual cancelation but with bad or netural feedback?
or just cancel and forget about it?
what do people think? am i being unreasonable?

If you cancel, you can't leave feedback. They also don't pay any fees for wasting your time by misdescribing the item. It's up to you, but I'd refuse the cancellation0

Is there a chance that the seller could raise a NPB dispute if the buyer doesn't cancel?0

If the seller raises a cancel by mutual consent then I would think (but I don't know) that by refusing you are saying you still want to go ahead with the purchase. At that point the seller could raise a NPB.
Maybe you could beat them to the first punch with a Non Performing Seller? (Item significantly not as described). Also by asking you in advance to perform a mutual cancellation to avoid fees they are asking you to complete the sale outside of eBay, which is strictly against their T&C. A strike of this nature is possibly more damaging than negative feedback.

Seller cannot open a NPB if they have opened a cancellation request, you cam only do one or the other.
If you did agree to it you can still leave feedback but in this case I would not agree if I were you.S.P.C member 1662 - target £3000 -

What on earth do you think eBay will do with it.
If they have opened a mutual, they cannot change it to a NPB.
If they have opened a mutual one of three things will happen. Either you can decline it (within the timescale) and they will not be reimbursed their fees. Or, you accept it and they get their fees back. Or you do nothing and in 7 days it times out and they get their fees back.
No matter what you do, both buyer and seller can leave feedback if the mutual has been opened.
Despite all of this, you have NOT paid, so why would you make the seller pay fees? The fees are his fees for the SALE, not the inducement. The feedback you leave should reflect your experience, not whether you let him reclaim his fees or not.0
