Bear in mind it's safer to use a standing order than a DD....;)

Yeah but your not protected with SO if they acidently take more money out than they are meant to then its up to them to give it back, least with DD you are protected in that way if that happens.

With an SO you are sending them money.

With a DD they are taking money.

So the above doesn't make sense as they can't take more money they are meant to on a standing order, because they're not taking it, you are sending it!

yes it is a bit worrying. Did i act to soon?. Got a letter today that was typed after i spoke to them stating, their records show i have not paid 207 pound and i have defaulted. as a result my account has been passed on to the home collections division, this may involve a representative calling at my home address within the next few days. It it stressed (their words) that payment reach them no later then the 21st (today). They emphasise that if i dont pay they will send someone round and have no alternative but to recomend their client that solicitors and commence legal procedings without further notice.

should i be worried. i thought i had this sorted with them as per my above comments

    regards

you could ask them to check their recorded calls see if the "agreed" call is there.

Also, having "agreed" with them, they're not making an unreasonable demand. There is a link to the Office of Fair Trading's website about this somewhere.

Angry dog do you think they are not making an unreasonable demand. Doe you mean i should pay asap to avoid debt collectors etc.they did agree over phone amount over four years rather than five?.
its just i cant pay over 200 a month in six months i tried i paid over 600 but short of sellin a few posseions i cant do it. My debt to them now is about 700 and they demand that that in 3 months. My debt to barclys is 10000, they were happy withh 60 a month with no final end date they also offered me final payment of 4500. And will offer again bi anully.

For my two pence worth I would wait until January. Yes I know the clock is ticking, but it's also likely that HO and all other staff will have a nice break and can't send you anything :)

Their representatives, or home collections department, have no legal rights to enter your home or remove goods, they are not bailiffs. There is no need to tell them to *&^% off, just ask them politely to leave. Remember if you raise your voice or swear you may be in contravention on Sect 5 Public Order Act! You have the right to call the Police if they don't leave.

If they leave and come back again you may have grounds for harrassment.

If you speak with them you are not legally bound, though they are usually asked to call round to agree a plan for repayment.

They have a printout of recommended payment plans from HO and this is a sliding scale between months/years and pounds/pence. Obviously you can pay any debt off sooner at higher monthly/weekly outgoings, or pay it longer term at a cheaper rate. That is your choice.

However please bear in mind that the agent that calls can take a lower than HO recommended payment each month.

I'm not going into the whole 'whose debt' or 'should i pay. scenario, I'm solely giving my two pence on the home collections guys.
