Should I pay for Eon Mistake?

Hi Im in need of some help...the story goes....we moved countries in July and are renting our property out, the letting ages let Eon know the final readings, we received a final bill with a £62 refund, this was paid into the bank, jobs a good un........until now, we receive a letter saying we owe them £62 DEMANDING immediate payment as it was unpaid form the last statement - for one we never saw this statement and it appperently goes to August.

I got in touch to ask how this is so when they refunded the account and there was an apology as they paid it twice, I responded as we have no money in the UK and so to pay it will cost us a transfer fee, there only response was
'
Under the Direct Debit guarantee we are entitled to request the money to be repaid.'
Along with a comment about how to pay from abroad - hmmm like I didnt know how to transfer my money here!!

I have no problem repaying BUT why should have I have to pay extra for their mistake?

Where can I go from here? AM I entitled to not pay anything back (Only because the curt email has cheesed me off!)? Or am I entitled to repay less anything it wil cost me?

Cheers

  • If it was EON that owed you money would you say that it was OK and they didn't have to refund you?

If yes then I agree you shouldn't have to pay them

    If no then pay up

  • If you used the energy you owe the money for it - end of story.
    Thinking critically since 1996....
  • Please read the OP. They are not complaining about the £62. They are complaining about the extra fees it will now cost them.
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Even more so - they are complaining because they owe Eon £62 because Eon refunded them TWICE! If Eon hadn't made this mistake they wouldn't owe anything.

I'm not sure where things stand legally, but if the OP has no financial presence in the UK then Eon will have no way to recover the money anyway?

No, but not being in the UK just means the debt will be waiting for them when they come back, it may mean a ccj, credit file trashed etc, is it worth it for a couple of quid.

Well I might be missing something but if they are letting out their property here in the UK, presumably the rent is being paid by the tenants in sterling - so at some point either that money is sitting in a bank account waiting for their return or it is being transferred to a bank account in someone else's name or there's a third option that I can't think of - but still the rent is being paid in sterling.

So - assuming EON have refunded the money twice (and the OP hasn't confirmed that this is the case) - why can't this STERLING money be used to pay EON? No charges everyone's happy end of story.

  • The rent is covering our UK expenses - nothing spare!!

Its a double refund for UNUSED energy!!

I no problem paying back, the problem is its going to cost me to do it from the continent, I belive I should be in my rights to deduct the expenses as it was THEIR mistake

Write to head office with some examples of transfer fees and ask them to deduct the fee from the £62. Be very polite, assure them you're happy to repay the money but you feel a little aggrieved that, because of their mistake, you're having to stump up transfer fees. Alternatively you could simply deduct the fee from the sum owed and write to them advising what you've done. This latter option is a little risky though. Always better to ask first. I think any reasonable company would be happy to comply with this. It's their mistake after all.

So how are you going to pay your UK expenses when there is a rental void or an unexpected expense - both of which are almost certain to happen at some point?
