ex display kitchen sold as soon

Hi Danemi1
Just a couple of points to pick up on - hopefully it will help a bit.
Plinth - Standard English plinth height is 150 mm, so you would be able to get this anywhere. Has the kitchen company not offered this to you at a good price?
Walnut door colour - This is a risk that the replacement door is a slightly different colour to the original ones. This is because the door is a real wood veneer and as a natural product there can be colour differences on different batches, also woods do often change colour with age. I am sure though a french polisher could sort any colour variations on the new door.
You can get a really good deal on an ex-display kitchen but there often proves to be issues when the layout has to change, but with a decent fitter most of the issues I am sure would be resolved.
Good luck.

thanks ck - I think what we have decided this evening is - we will get their fitter to put the combi micro and warming drawer into the larder and then it can be with us for start of December giving our chippy chance to sort out the rest of the probs - means losing my larder but there are plenty of cupboards so am hoping it will be ok, we can then use the new door as the filler panel where the talls stand at 600 but the rest of the units are 750 (because of the tambours) so the talls have to stand forward so that they are in line and you can open the door - this reveals a gap obviously at the side of the talls - the new door will get used for this I guess - expensive way of doing it hmmm!0

I find it staggering that any kitchen could cost £32K.
There has to be a huge mark up on that costing surely!
Even a quarter sounds an awful lot for a tight as.... sorry, I mean money saver like me!
Like everything in life there are many levels of kitchen, with lots of price points. Another comparable product to kitchens at similar values would be new cars, although there are far fewer cars to choose from than choices of kitchens. You can buy a brand new car made in India for £6k right up to over £1m for a Bugatti! Kitchens are just the same, cheap cr*p from China up to some amazing kitchens from Italy or Germany for several £100k's.

we have tried to work around this - we have spoken to our carpenter who is involved in the extension build - he will alter the units if and when necessary and cut the island down to size etc etc so we have gone back to the kitchen shop - we ordered at the time of purchase a new worktop - this funnily enough also wont be here so even if we take delivery the worktops as well as the doors wont be here until Christmas week - it just gets worse and worse - I just want a refund now and go to Ikea and get one from there off the shelf. The worktop is not specially made so why why why
It is driving me potty and the guy just seems so ruddy unreasonable!
I would imagine the builders stop work for 2 weeks over christmas so we are going to be without a kitchen for at least 2 weeks
We paid with a credit card for protection - will we stand any chance of fighting it?0 -
You can speak to your CC company and tell them that the company are refusing to deliver in time for it to be fitted before Xmas, which is what was agreed. When we had an issue recently, Barclaycard just asked us to fill out a form and gave the money back.
Otherwise, I wouldn't compromise on losing bits of your kitchen for the sake of getting it here for Xmas. It's pretty clear that Mr Kitchen man isn't making money on your deal and is therefore using his manpower on getting people's profitable kichens fitted in time fir the big day. Keep that scratched unit door as I'm sure it can be fixed with a bit of french polish magic.
I guess you need to establish if your people are going to be able to fit it for you when he says it's coming, otherwise you'll have to hold your breath. No doubt, it's left a bitter taste in your mouth, but it will still be nicer than an Ikea kitchen (which I have just ordered!) for the sake of a few weeks, even if it is over Xmas?
I can't even live in my house at the moment, and there's still as much stuff being stripped out as being put back in at the moment - I too am holding my breath for Xmas - I still keep buying stuff!Everything that is supposed to be in heaven is already here on earth.

I waffled a bit there, I think my point was...
If today was the 2nd week of Jan and you were sitting at the breakfast bar in your fancy, posh kitchen, even though Xmas was a bit tough, are you still sure you would have wanted a refund and an Ikea kitchen? If you are, then get on the phone now...Everything that is supposed to be in heaven is already here on earth.

Just a bit of a story and the experience I went through with something I sold to a customer as ' Sold as seen'
I had had a pure marble fireplace surround in my shop for a few years, it had a pinky 'tinge' to the marble and with subsequent moves also had paint on it.
A lady customer came into my shop and fell in love with it. She bought it at a greatly reduced price, over 90% off, just to get shut of it. It was labelled up as sold as seen. There where some chips, broken pieces and it was very grubby.
I thought she was a nice lady, so when I took it down, I sent it to my Marble workshop and asked my mason to give it a good clean up, fix any broken bits and get rid of any paint and give it a good polish.
We delivered it to her old house ( she was moving in 4 weeks) she paid and that, as far as I was concerned was the end of it.
She came into the shop weeks later, screaming that it wasn't the same surround and she wanted her money back. I explained that it was, I did a favour and cleaned it , so she wouldn't have to ( at no extra charge) She wouldnt give up. She stated she was secretary (PA) to chief constable and she would cause trouble for me if I didn't give her the money back. I refused.
I got hit with small claims court summons and on the day I went. Dont ask me how but I got through the courts security with a stanley knife, along with samples of pure marble and some wet/dry.
We went into the hearing. The magistrate ( or whatever he is called) listened to her side then asked me for mine. I scratched a great big mark in the marble and then scrubbed it with wet and dry to show, whatever I did to her surround wouldn't take the colour off it, It was the same all the way through.
Anyway, Magistrate said ok, I have made my decision and he sided with me. Not because of the what I showed him, rather that I had stated on the paperwork/invoice it was ' Sold as seen'
This happened 3 years ago in Liverpool Crown Court
Moral of the story is, if you want something 'perfect' and want the option of compllaining about a product, NEVER buy Sold as seen.
If the Kitchen guy is offering money back, I would take it with open arms, he doesn't really need to do it.0 -
danemi isn't asking for the kitchen to be perfect. She's asking for it to be delivered in a timely fashion. From this thread, you can see that she's prepared to be flexible with what arrives and make do with it all but he's refusing to deliver it in any timely fashion. Considering that it's probably already been ripped out, the's got no real reason to have her money and keep the kitchen until it suits him to deliver.
rustyboy21, Your lady wasn't happy with what she got, when she got it. I'm glad the judgement went your way, she clearly had a good deal from you. Danemi hasn't even got the luxury of having a kitchen to fit when she told him it was being fitted and he agreed to supply it.
It's different circumstances.
A small claim would never happen in a crown court. You mean county court?Everything that is supposed to be in heaven is already here on earth.

No it was actaully in the Liverpool main crown court Buildings, there isn't a magistrates court in there, but it was held in an office type room. I am not aufait with courts lol. It does say ( almost sure )crown court outside
I appreciate she is having a hard time, it was a general warning to other people, don't get sucked in to buying products ' sold as seen' unless you are fully prepared for them. You know how this forum works, eeryone putting their oar in, me included, didn't mean any harm
Doozergirl, you seem to be well up on things, does ' time is of the essence' rules help in Danemi's case? Do they still exist?0
