    I agree, but that's the law as it stands at the moment, and shops can prevent this by being aware of their obligations.

    Aye, despite my opinion of it being excessive, I do agree with you. Especially with them selling high valued items i'm surprised they'd be so slopping tbh -- now they've just lost a sale because of it they might learn from it.

    Regarding the 3month+7day rule, I think it's a little excessive. In future you should ensure goods are checked for suitability straight away as not all companies will forget to include this information leaving you unable to get out of it on a technicality.

    I largely agree, three months does, on the face of it seem excessive, but, it is incumbent of the seller to ensure they are fully aware of their duties, when it comes to informing their buyers of their rights.

    All too often we read of sellers trying to circumvent the regulations and deny consumers their rights and in those respects, three months sounds about right. Trouble is, we can't seperate the sellers who have simply made a mistake, from the ones who are seeking to rip us off. Therefore, the three month rule is what it is and they all have to abide by it.

  • Argh, ok so after all that I have double checked the delivery docket and in tiny writing at the bottom is the following...which I guess is enough for them to not accept the return? Sorry if I have wasted your time, not sure how I missed that last time round!

    This is not a declaration of your rights under the DSRs, mostly because they are in breach of such regulations. The seller is not allowed to charge a restocking fee if you cancel the contract within the allowed time and the above only relates to "Damages/Discrepancies." The above conditions are designed to discourage consumers from cancelling and is in contravention of the regulations; not to mention the Sales of Goods Act.

    I would continue with your e-mail to them tomorrow. This changes little, if anything at all. In fact, your local trading standards office might be interested in their tactics to put people off from exercising their rights under the DSRs.

  • Ah - was hoping you would say that FlyBoy :) You are a godsend! I did think the damages/discrepancies was quite ambiguous and restrictive...

    I had already sent the mail anyway, I also phoned and politely informed the customer services manager of my mail. He has said he will read it and come back to me on Wed...i.e I will phone him on Wed!!!!

    If you have any legal cover with your car/household insurance, it might be worth getting a professional legal opinion on it as well.

    I suggest pre-empting that and call your legal cover providers tomorrow.
