Big purchase - price reduced online before item received

I ordered a large (and expensive) item of furntiture back in September believing it was in stock, as per the sellers website. On ordering, I was then informed delivery would not be until end of October.

But now the item is not only further delayed for delivery at beginning of December (!!), the item has also been reduced online.

Although I paid for my item in full at the time of ordering (becuase we were led to believe it was immediately available), can I now insist on a refund of the price difference?

  • You can ask for a refund of the difference, but they have no obligation to give this to you.

    If they won't agree, you are quite entitled to cancel under the Distance Selling Regulations, obtain a full refund, and re-order at the new, lower price.
  • If it's standard stock you have the right to cancel the order under DSR and order it again at the new price

    They must allow you to cancel it and refund in full, but they don't have to accept your order at the new price, and they don't have to simply refund you the difference.

    Best thing to do is ask. Considering the long delay in getting the item to you they may do it out of goodwill. Or you could try threatening to cancel and going elsewhere and seeing what they say. But if you do cancel you may end up not getting it at all.

    You can cancel your order via the DSRs but you have no legal right to demand a refund of the difference. You could though try re ordering at the new price. The best option though is to speak to the seller and see what they say.

    Out of interest if the price went up would you be offering to pay the difference?

    No. You can ask & as a gesture of goodwill they might reduce the price. Alternatively, depending on the T&Cs, you may be able to cancel the order/reject it under the distance selling regulations and then reorder

    Was the purchase of the goods done online or instore, its not 100% clear that it was originally purchased online, DSR will only apply it it was
  • If the price had gone up in the time between ordering and delivery, would you be as keen to write out a cheque for the difference?

    A textbook response when people post a query like the ops. I am surprised it took so long! However as always a useless response. All the op needs to do is return under DSR and then reorder at the new price. As this is a hassle for everyone I would be surprised if the company don't just return the difference. I have been in similar situations and have never had a problem.

    I would suspect that the order was made online - "believing it was in stock, as per the sellers website" - so DSRs will apply, as long as the item was not custom-made or otherwise customised so as to remove the right to cancel under DSR.
