take royal mail to court?

My story is this, the shortened version:
Royal Mail (royal fail) have basically lost my passport and driving licence. It was sent to myself tracked, and according to the Royal mail, they have attempted to deliver it twice, and twice,they DID NOT leave a ''sorry you were out card''. Therefore I wouldn't have a clue it was at my office depot.
After weeks of back and forth and Royal fail clearly not knowing where it is all they suggest is putting a claim form in which could take up to 30 calendar days, and its not guaranteed that ill ever get it back. I am leaving the country in less than 21 days, and i am leaving so ive had to resign to buying a new one or i dont get to go.
I know I probably haven't got a leg to stand on but does anyone know if there is anything I can do for justice, as I have had to fork out for a new passport and licence??

Unfortunately, Royal Mail are completely above the law and cannot be sued.

Even if Royal Mail could be sued, I doubt you could sue them. Their obligation is to the person that contracted them to post it.
Who was sending the passport to you? Its not something that happens often (getting a passport) but I seem to remember when I ordered mine it was sent by the passport office by normal post? If it was the passport office that sent it to you I would imagine they have to replace it free of charge0 -

I'd be very surprised if that was true. Most branches of government can be brought to court (by judicial review if need be); almost every dept has some protocol for decisions to be challenged, many of which ultimately end up in the law courts.
Maybe there is an ombudsman instead that the OP could raise their complaint with? :cool:0 -

Probably neither.
There is another service called "Royal mail tracked" which is only available to business customers who send over a certain amount of packages yearly. 9I think that it's about 2,000 to 3,000
This service provides online tracking up to the point of delivery but unlike recorded or SD, a signature on delivery is not obtained as part of the standard service.
It doesn't offer any extra compo for lost of delayed mail and is still limited to the equivilent of 100 1st class stamps.0 -
if it's a Special Delivery item, it'd be kept for 7 days in the delivery office before being returned to the sender, who presumably put their return address on the item. If it's Recorded Delivery, it'd be kept for the same amount of time before being returned to sender.
If it's a Tracked item that would have fit through your letterbox, well, it'd have been delivered.
The onus is on chasing up with the person who sent it to you...0 -
You can submit a claim to RM as a recipient, althought bearing in mind it is not infact op who has a contract with RM so not only would it not stand up in court, i'm not sure if RM would pay out or not.
With regards to taking them to court, I do believe thr postal services act 2000 actually blocks this and is has been substantiated in a previous post. I'll try find more specific info, but in the meantime another member will probably have the info (custardy will probably know if hes around also)0 -
OP, what has the sender of these documents got to say?

SD are kept for 3 weeks,7 days is for RD.
OP. why do you have 2 attempts at delivery? RM don't reattempt unless a request is made0
