could i get away with this

I just wondered if i could get away with this, Basically in my company where not allowed to take holiday's from the 11th december till 11th of january. Its written into the contract unless you get senior proir approval. Ive had holidays booked for christmas eve, day and boxing day since may of this year. But now theyve turned around and said oh you cant have them your not allowed ok i wont disagree with this. But i wondered if i could get away with this
I'm on a 0 hour contract and if we get into trouble we are de allocated shifts pending investigation then if your found innocent of said offence because we wheren't suspended just de allocated shift's we cant say we want paying for them shift's that you suspended for.
So could i de allocate myself over the christmas period would this work if they can do it to me cant i do it back if im on a zero hour contract can't i decide when i want to work.

    If you are on zero hours, can you decide when you want to work and just not take the hours that you don't want?

    You could do it, you could get away with it.

    You deallocate yourself from shifts as you don't want to work. They see this having expressly said no holidays over this period so in return they start giving you the bare minimum of hours on a weekly basis (may be as low as the zero you are contracted too).

    Are those 3 days holiday worth the potential issues of minimal money coming through the door?
  • if you're on a 0 hour contract you are not required to work any shifts that you don't want EVER...

    however the employer is equally intitled to not give you any shifts...

    so you might get christmas off, but equally find you're not working much of january either :(

    Down to if your Zero hours contract is mutual agreement some are one sided so you can't refuse a shift.

    If you do have the option to be unavailable then just go without pay for those shifts and make up the ay with holiday when you don't have full hours.

    Remember the result might be reduced/zero offer of work, not an issue if they are short and will have to use you.

  • Sorry, I've read that twice and I still have no idea what you're actually asking.

    How exactly can you have "booked" the Christmas holiday since May, when you're not allowed to book holiday between 11 December and 11 January?

  • well i submitted a holiday form in may for holidays in june september and christmas !!!!!! all was said about them i just took them no yes you can have um now 6 months on theyve noticed ive applied for holidays over christmas and instead of refering it on to higher people (which is the only way they can be granted )its just been thrown back stating reason for that is you anit allowed holidays in december.

    I would guess a zero hour contract and needing to book Christmas Day off means it is work in the hospitality trade. Need to be very careful exactly what sickness you have.

    And have you asked them to refer it on to 'higher people'? Do you have a particular reason for wanting those days off? (please tell me you haven't booked flights to far flung family ...)

    I'm just wondering if it's 'always' been known that no holiday will be granted in December, in which case you should have known you weren't likely to get those dates, or if they changed the rules part way through the year.

    If there's a shift system, when do you get the rota, and have you thought of swapping shifts with others?
