I think you're referring to the revised regulations coming in.. (can't remember what year now)
At the moment postage should be refunded in full, however the revised regulations will mean if the consumer upgrades shipping at a greater cost they will only be entitled to a refund of the standard shipping service.

Interestingly thats from OFT but within the actual DSR's themselves, it doesnt seem to be included. I suspect it would fall into the category that the service has started so no unconditional right to cancel though.You keep using that word. Interesting indeed, i've always thought this wasn't the case where postage was concerned. That does make it a whole lot fairer for the retailer.0 -

the additional services were provided under a separate contract
So if the extra postage was paid for at the same time and on the same invoice as the goods in question then the retailer must refund the cost of this.0 -

So when i sent them back and my refund came through, boohoo.com had only refunded me £32.30 as they said that i wouldnt get my delivery fee back or my discount of 15%. I do not understand this, how could i pay £38.29 and only get £32.30 back? The 15% discount voucher basically made this free delivery and it looks as though they are tring to take another 15% off me? Well just to clarify, you paid £32.30 for the dresses after the discount was applied, and then £5.99 for delivery. And they are refunding you for the cost you paid for the dresses. They can't refund you a discount... Just what you paid for the items.
Also, this is stated clearly in their Terms and Conditions under "Refunds":
"Products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you providing there is only the item in the order. If there is more than the defective item in the same order, the delivery charge will not be refunded."
Because you sent back your other dress as well, they didn't deem the entire refund was due to a fault, because you obviously also wanted a refund on the item which was not faulty. Hence you not being eligible for a refund on your delivery costs. It kinda makes sense, although I can understand you're disappointed.
I am not taking any sides here, just stating the facts. It is what it is, and I guess it's a matter of reading the return policies before you buy, and before you send something back.
