  • if mr cutts got taken to court by excell what stopping them taking other people to court, i am thinking they wont because they lost but what do you guys think was special that excell managed to take mr cutts to court in the first place the only reason i am asking is because i got a ticket in same carpark?

    Main reason they tried was Martin Cutts contacted them and told them he was not going to pay as the signs were inadequate. Excel thought because their signs met the overall dimensions recommended by the BPA they were on a winner if that was the only defence. Luckily the Judge agreed with Mr Cutts. The signs never made it clear it was a P&D and instead concentrated on the charges for breach of conditions.

    Hence the reason we say don't contact them at all, if you do they think they have a bite. Also if your not sure of what you are doing you can encourage them even more.
  • i contacted by appealing online but that was before i seen this forum, they have my name address and they know i am the driver, i am going to ignore but am i right in thinking they might try harder to get money of me given the information they have about me?

    You are reading far too much into this fake PCN and not reading enough information. And you did not appeal. There is NO APPEAL.

    If you had followed the advice given and read the stickies (info threads at the top) you would have found the Watchdog clip for yourself! It was cunningly hidden in the sticky thread 'welcome, please read before posting'!

    Please, please just read the 'welcome' thread and also look at the letter chains in the top sticky thread. That's what will happen. Just letters.

    OK.

    When you find a random thread on any online forum, take a step back and look at the sub-forum, the board the thread sits on and read the info threads at the top which are called 'stickies' as they stick permanently at the top of the board like notices.

    To do this, look at the top of this page for the blue link starting Home > Forums > and so on (it's in small writing, always written as a chain-link on any forum, always with > inbetween each step, and it ends with the name of this thread).

    So ALWAYS take a step back. Click on the link before the name of the thread. Clue - it's mentioned in my signature!

    If ever you find a random forum post when searching for information online, do not just reply on it as it's confusing to hijack a thread that someone else started. Always look at the actual board the thread sits on by going back one link in the chain and starting your own thread if the stickies do not have the answer you are looking for.

    Never knew that. And I only worked it out myself when I started to use forums regularly a few years ago.

    Once you know how it's easy to find your way around any new forum. But so many newbies just 'teleport in' after a Google search and think the thread they have found is the only one!

Take some time to read the stickes and some other threads and you'll understand that these clowns will probably send a few pseudo-threatening letters but they are toothless. They rely on ignorance of contract law, and consequently rarely if ever "do" court.
