In law, EVEN with a DD, consumers remain responsible for any debt, whether or not the supplier remembers to collect it.
Which law? If the contract states that the supplier will collect payment by direct debit, and the supplier subsequently fails to do so, then the supplier has no claim against the consumer.

its a contract for £25 amount for 24 months, so thats what I would need to pay over the term
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

If the contract states that Vodafone will take payment by direct debit, then it's Vodafone's onus to collect, not your onus to pay.

I can't help thinking it's no coincidence they have a new mess at around the same time they decided to stuff their customers (not for a change!) and arbitrarily increase existing contract prices. They can't cope with the simple process of billing correctly normally that alone tinkering with their so-called "system". Oh, yes - their excuse was that it was meant to "simplify" things...!

There's a silver lining; it must be costing them a small fortune in negative cash-flow and adminstrative costs (judging by their normal standards I'd say they don't actually pay much for administration). Perhaps they'll manage to pin down one of their illusory managers who always disappear when a customer has had enough and demands to speak with them; though I would be amazed if any of them were competent enough to actually manage anything, that alone this. Can't help smiling at them running around, not knowing how to fix something they failed to set up properly in the first place. Now for once it's their problem, not ours!

Really? The law of the land states differently. A DD is an intention (an 'aspiration' if you like) to pay, not proof of payment, and the latter is required to save problems later. Only the funds being paid over is proof of payment, another problem with DD's, is that if the originator doesn't collect, the debtor is still liable.

Yes, the debtor remains liable, but the supplier cannot claim breach of contract for non-payment by the debtor when the contract puts the onus upon the supplier to collect the payment and the supplier fails to do so.

When you say the "law of the land", which law are you referring to?

  • *update* the dd will be attempted on the 18th of november. novembers dd will go out as normal on the 27/28th. sms updates are being sent out in stages to ease the call queues. the customers credit file will not be affected as vodafones systems show as balance paid so will not reflect on any credit report and dd failure charges will be refunded on production of the letter to any store.
HTH and many apologies for any inconvenience.
