Urgent help required Unfair Dismissal

    As background, the OP has a couple of other threads that might relate to this one:

    In this one, he asked for advice on behalf of a workmate who had been dismissed (and mentioned that he'd "found" emails on the company computer system that might help his workmate's case).

    A couple of months later, he started this one, in which he explained that he no longer worked for his employer and wanted to know if he could have a copy of an agreement he'd signed re the employer's bank account and login details.

    OP - what stage are you at now? You say the judge didn't accept your argument - has the tribunal finished and you are wanting to appeal? Or is the hearing ongoing?

    Not necessarily. The OP may have changed jobs from finance to [for example] admin and thus left the finance office with no log-ins. log-ins for small company bank accounts are pretty generic and usually a select few will all be able to access the account and keep an eye on all transactions.

    As Kiki says - we are assuming that alot more has gone on in the background here and without further details it's hard to see how it is an unfair dismissal knowing how these things work.

    If you have had the ET your last option is appeal. Then you're done.

    There is more detail to this case and I have been dismissed. But the employers main reason for dismisal was a breakdown in trust and confidence in me. The incident they are relying on was my failure to pass my login details to a new employee. The judge today refused to accept from me that I was bound by the T&C's of the bank which prevented me from sharing the details.

    I think the ET judge is wrong and should allow this point to be clarified before proceeding with the case. He refused my request for this.

    A number of other employess have access to the bank accounts and none of them are prepared to disclose their details.

    That really makes no sense at all. Do they all have different log ins?

    Have they been made to give evidence to state this? Were they asked too to share the log in with this employee?

    Can you clarify? Are you saying that there are multiple ID's which can be authorised to operate a single bank account? And that the employer could have arranged for another ID to be given to the new employee? Or what, in your way of looking at things, is the correct way for a new employee to be given access to the company bank account?

    So the question is - is another employee a third party to the company/bank relationship or to your relationship with the bank on behalf of your employer?

    Many thanks for all the quick replies to this. I'll try and clarify the detail.

    I had to sign a form from the companies bank to register for online access to the companies accounts. This was was very comprehensive and had personal details from me. Each person authorised to access the bank accounts completed their own forms. Unfortunately I do not have a copy of the form and the bank have refused to let me have a copy.

    My reason for not disclosing my passwords was to protect myself against someone else using these and making it look as if I had done this.

    My argument is that the passwird details are soecific to me and should not be given the anyone else.

    So what I have been saying all along. Why did you not put it to the company that IF you had given this person your log on and they had stolen from the company who would be to blame?

    I can not see seriously that they sacked your for looking after their interest! How long have you been with the CO - is this reason stated in the dismisal letter from them?
  • Aah, if that's the case then I agree that the password should not have been given to someone else.

    Why didn't they just start another access account?
