Hi there, sent Sainsburys Credit Card to court received a response from them stating they would pay back £75 which they consider half of the costs. I have made a big mistake by including interest charged as well as late payment charges totalling £648.00. What do I do now? will I have to re issue a summons for the new amount? and will I have to pay another court fee?

If their offer of £75 is unacceptable, which seems more than likely if you are claiming £648, then all you have to do is to allow your court claim for the higher figure to continue its progress.
What was so wrong about claiming interest? OK, up to now it was just a bargaining chip but, now it has got to the court stage, it should be claimed anyway.The acquisition of wealth is no longer the driving force in my life.0 -
Thanks for the reply but I understood after I issued court summons from this site that you can not claim for interest charged by your credit card company on late payments only the late payment fees themselves! is this right?

I believe there may be some confusion between interest charged by the bank against you for going overdrawn or whatever and the interest you can claim on the time since the charges were made against you?
You are correct in that you cannot reclaim the interest that the banks have charged you for going overdrawn (as shown on your bank statements).
However, as pointed out above you can (and should) claim interest from the date the bank charged you until the present day. I think this is at a rate of about 8% pa, but I'd use the calculation spreadsheet if I were you.
If you have made a mistake and it hasn't already been submitted to court then send the bank an amended amount letter. It doesn't really matter at this stage.
If you have already submitted the amount to court then I wouldn't worry about it too much as the judge will either award you less (taking the amounts you can claim off) or just award you the whole amount anyway0 -
