It's not automatically assumed. 2 people of the same sex living in a 1 bedroom flat will be questioned. If 2 people of the same sex live in a 2 bedroomed flat it's down to how they answer the questions. Your flat mate answered the question or one similar is there anyone else living in the same household? Yes... You are 2 seperate households under the same roof so the correct answer is No.
I disagree, they have a joint tenancy, anyone else living with you should be answered "yes".

Exactly and the Welfare Benefits Officer agreed with me, took copies of everything, phoned and spoke to an ESA Supervisor and it was basically agreed that the person on the phone the other day was unprofessional and it will be looked into.
Everything else will be investigated once they receive her form, Subject Access Request and the copy of the letter to my local MP, which has been recieved in email form and replied to by his local constituency team and his Parliamentary Assistant at his Westminster Office, both with the promise of the MP's personal response, already.
Naturally this doesn't guarantee a positive outcome, at least initially, but I at least now live with someone who is in a better frame of mind at the moment knowing support is there and a good case is being formed.
Paranoia has set in though. On the way out to see the Welfare Benefits Officer, a lady in a car was writing something down on her clipboard. Yes dear, we were on the way to deal with the issues your organisation has caused.0 -

If it's a joint tenancy you have to answer yes, otherwise they would close your claim when they found out. What they usually do is ask to see the tenancy agreement.
If the joint tenants refuse to provide details, it shouldn't become an issue because a decesion maker will realise there is nothing they can do to force disclosure.
Oh and if you had a joint tenancy with other people they would more than likely know your name, you don't take a out a joint tenancy with complete strangers! It's not about lodgers, lodgers would be on seperate tenancy agreements.0 -

What we are doing is fighting for our independence from each other to be treated as seperate people, as it affects both of us.
I see what you mean though, but that has all been handled in the correspondence with our local MP as I don't wish to divulge too much information regarding her condition on here.
We will be careful, but at the same time we have nothing to hide and have enough support and guidance to help us, both here and in real life.
So, thanks to everyone for their help & advice and to epitome for the letter, which has been used.
