You have a choice where you put your replies and I have the choice to reply however I wish. Glad you had to run off to do some policing though

PS and for those wondering about the linked thread , basically a poster had gone out with her chap and once they returned a domestic dispute had occured, many were suggesting to the OP that she should leave her chap immediately, however as she was in love and can see sense, she has decided to make a further go of her relationship rather than follow the masses opionion, this lead for me to be the most hated poster on MSE0 -

I think this is probably one of those cases where the CSA should be held largely liable, and although ultimately it will be at all our expense (the tax payer - glad i am not one of them anymore), it does seem a little unfair in her case as she would of had other avenues open to her had they closed and notified her of the situation...!
We all know how slow the CSA can be, but 6-7 years is a little too much, had it been me that overpaid, i think i would be more inclined to go after the CSA for this rather than the PWC...
And my advice to the Original Poster would be make a formal complaint, send it recorded delivery and copy in your MP, also email and fax as well, they may well get 3 copies, but then you have 3 different proof of delivery as well...! Do nothing over the phone, and if they do call again, politely refuse to speak to them and ask they write to you in the future...!
In your reply, state that you do NOT agree that this be overpayments, but gross negligence on there part. And they if they wish to obtain the monies back from you, that you suggest they take you to court to recover it..!
IF you have any kind of contact with your ex, suggest that he goes after the CSA to recover the money from them, and to instruct a solicitor to take them to small claims court. using the paperwork that they have issued to you, he cannot lose..! He will also get his money back a hell of a lot quicker...!
I know this is not an ideal situation, but this is the kind of case that just shows the incompetence of the CSA, and with the right paperwork and wording maybe a solicitor as well, i cannot see how they can make you repay...! The easiest answer is, i hold you completely liable for ALL lost monies due that would of been recoverable using remo had i been given the opportunity, and as such hold you responsible for compensation to the amount of the overpayments...0 -

I agree, however in my mind somewhere along the line, the PWC should have had some idea that they were in reciept of payments which were not warranted , perhaps the NRP may not even be involved. It is not the case that every NRP is trying to evade paying or that every PWC is seeking as much as possible. But if it is the goverment that has paid out the monies and it is they that are owed, then you can rest assured, no sob story is going to be classed as exceptional circumstances and it will have to be repaid eventually.0 -

I suspect if you are over paid then you have to pay it back, in fairness if you were under paid then you would be kicking up fuss wherever in the world your ex is.
Thing is who are they going to pay the money back to?
The money will be paid back to the Government/Secretary of State. if they have calculated an overpayment then it means they will have already repaid the NRP the £20k, from the taxpayer's pocket, and now as such they will want to recover that money from the PWC.
OP, could be worth speaking to your MP about this. If you genuinely didn't know that the NRP in your case had moved abroad and no longer had to pay maintenance then it would have came as something of a shock to find out that they need you to repay all of this money. Your MP can intervene on your behalf and arrange a repayment plan, it might well be a mickey mouse amount of £10 per week or something, but ultimately the Govt will expect this money to be paid back to them.
I would ask for an account breakdown to be carried out, to ensure that the £20k is correct.0 -

They don't pay out money that hadn't been collected from the NRP - perhaps he was paying by standing order..?0 -
So in some way it would of been due, if he was working in Canada it would still of been due just through the REMO system and not the CSA...?
If this is the case then it is down to the CSA and there incompetence that this cannot be claimed now... VERY VERY UNFAIR...! Especially as he would still be liable to pay it...0 -
